SUBSTITUTE FOR

SENATE BILL NO. 1185

(As amended, June 7, 2006)

     A bill to amend 1961 PA 236, entitled

"Revised judicature act of 1961,"

(MCL 600.101 to 600.9947) by adding section 2922c.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

     Sec. 2922c. The court shall award the payment of actual

attorney fees and costs to an individual who is sued for civil

damages for allegedly using deadly force or force other than deadly

force against another individual if the court determines that the

individual used deadly force or force other than deadly force in

compliance with section 2 of the << >> self-defense act

and that the individual is immune from civil liability under

section 2922b.

     Enacting section 1. This amendatory act takes effect October

1, 2006.

     Enacting section 2. This amendatory act does not take effect

unless all of the following bills of the 93rd Legislature are

enacted into law:

     (a) Senate Bill No. 1046.

     (b) House Bill No. 5142.

     (c) House Bill No. 5143.

     (d) House Bill No. 5153.

     (e) House Bill No. 5548.
