A bill to amend 1974 PA 369, entitled
"Driver education and training schools act,"
by amending sections 1c and 7 (MCL 256.601c and 256.607), section
1c as added by 2004 PA 70.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1c. (1) A driver education course shall be made available
for an individual under 18 years of age within a time that will
enable that individual to qualify for a graduated license under
section 310e of the Michigan vehicle code, 1949 PA 300, MCL
257.310e, before the time that the individual is permitted by law
to have an operator's license.
(2) A
Subject to subsection (3), a
school may enroll a
resident who is not less than 14 years, 8 months of age in a driver
education course.
(3) A school shall not enroll an individual under 18 years of
age unless the individual presents a certificate of good standing
as that term is defined in section 310e of the Michigan vehicle
code, 1949 PA 300, MCL 257.310e.
(4) (3)
A school may use videotapes, computers, telecourses,
or other similar technology as part of the classroom instruction
portion of its driver education course. A student may receive and
use any of those materials at home.
Sec. 7. (1) A driver training school licensed by the
department shall maintain a record of instructions given to each
student. The record shall contain:
(a) The name of the school.
(b) The name of the student.
(c) The type and date of instruction given, signed by the
instructor.
(d) The fees or tuition charged and the payments made.
(e) A signed copy of any contract made with a student.
(f) A copy of the certificate of good standing, if the student
was required to present a certificate of good standing as a
condition of enrollment under section 1c.
(2) The student instruction records shall be kept on file for
a period of 3 calendar years after the student has ceased taking
instruction at or with the school. The records shall be open to
inspection of the department or its authorized representative at
all reasonable times.
Enacting section 1. This amendatory act does not take effect
unless all of the following bills of the 93rd Legislature are
enacted into law:
(a) House Bill No. 4338.
(b) House Bill No. 4339.
