     A bill to amend 1994 PA 295, entitled

 

"Sex offenders registration act,"

 

(MCL 28.721 to 28.732) by amending the title, as amended by 2004 PA

 

237, and by adding section 4b.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

TITLE

 

     An act to require persons convicted of certain offenses to

 

register; to prescribe the powers and duties of certain departments

 

and agencies in connection with that registration; to impose duties

 

on certain persons who are required to be registered; and to

 

prescribe fees, penalties, and sanctions.

 

     Sec. 4b. (1) A person who is an employer or employed in a

 


supervisory position shall promptly give notice of his or her

 

conviction to each employee that is under his or her direct

 

supervision if both of the following apply:

 

     (a) The person is required to be registered under this act.

 

     (b) The person has been convicted of a violation of section

 

520b or 520c of the Michigan penal code, 1931 PA 328, MCL 750.520b

 

and 750.520c, after the effective date of the amendatory act that

 

added this section.

 

     (2) If a person who is required to give notice under

 

subsection (1) is responsible for making the decision to hire an

 

employee who will be under his or her direct supervision, the

 

person shall give the notice at or before the time of making the

 

job offer.

 

     (3) A person who violates this section is responsible for a

 

state civil infraction and may be ordered to pay a civil fine of

 

not less than $500.00 and not more than $2,500.00.
