A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 5519.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 5519. (1) Within 2 years after the effective date of the
amendatory act that added this section, the department shall
promulgate rules setting forth separate emission standards to be
met by each of the following:
(a) Wood pellet stoves.
(b) Corn stoves.
(c) Multiple fuel stoves.
(2) A person who installs a stove that, at the time of
installation, does not meet emission standards promulgated under
subsection (1), or who operates such a stove, is responsible for a
state civil infraction and may be ordered to pay a civil fine as
follows:
(a) Except as provided in subdivision (b), $5,000.00 for each
day of violation.
(b) If the person is an individual and the stove is located in
the individual's residence, $2,500.00 for each day of violation.
(3) Violations described in subsection (2) are not subject to
section 5529, 5530(2), or 5531, except for section 5531(2) and
(10).
Enacting section 1. This amendatory act does not take effect
unless Senate Bill No.____ or House Bill No. 6523(request no.
07312'06) of the 93rd Legislature is enacted into law.
