A bill to amend 1978 PA 368, entitled
"Public health code,"
by amending section 9205a (MCL 333.9205a), as added by 2001 PA 163.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 9205a. (1) The department shall identify materials that
contain information regarding the risks associated with
meningococcal disease and the availability, effectiveness, and
potential risks of immunization for meningococcal disease, and
other diseases about which the department may recommend
immunization or immunization information.
(2) The department shall notify each institution of higher
education and high school in this state of the availability of the
materials described in subsection (1) and post the materials on its
website.
(3) The department shall encourage each institution of higher
education in this state to provide or make available to students
enrolled in the institution of higher education, and each high
school in this state to provide or make available to parents of
students attending the high school, information regarding the risks
associated with meningococcal disease and the availability,
effectiveness, and potential risks of immunization for
meningococcal disease and other diseases about which the department
may recommend immunization or immunization information.
(4) An individual enrolling in an institution of higher
education for the first time shall submit 1 of the following to
that institution and to the department:
(a) A statement signed by a physician that the individual has
been tested for and immunized against meningococcal disease.
(b) A statement signed by the individual, or by a parent or
guardian if the individual is a minor, to the effect that the
individual has not been immunized because of religious convictions
or other objection to immunization.
(c) A statement signed by a physician that certifies that the
individual is in the process of obtaining testing and immunization
against meningococcal disease.

As used in this section, "institution of higher
education" means a degree or certificate granting public or private
college or university, junior college, or community college.
