SENATE BILL No. 735

     A bill to authorize the governor to enter into certain

 

agreements when authorized by the legislature.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. As used in this act, "international trade agreement"

 

means a trade agreement between the federal government and a

 

foreign country to which this state, at the request of the federal

 

government, is a party. An international trade agreement does not

 

include a trade agreement between the state and a foreign country

 

to which the federal government is not a party.

 

     Sec. 2. (1) Except as provided in subsection (2), the governor

 

may not do either of the following:

 

     (a) Bind this state to the government procurement rules of an

 

international trade agreement.

 


     (b) Give consent to the federal government to bind this state

 

to the government procurement rules of an international trade

 

agreement.

 

     (2) The governor may bind this state or give consent to the

 

federal government to bind this state to the government procurement

 

rules of an international trade agreement only if the legislature

 

by a concurrent resolution approved by a majority of the members

 

elected to and serving in each house of the legislature explicitly

 

authorizes the governor to bind this state or give consent to the

 

federal government to bind this state to the government procurement

 

rules of a specific international trade agreement.
