A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
(MCL 750.1 to 750.568) by adding section 357c.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 357c. (1) A person who is an employee of an individual
licensed under article 15 of the public health code, 1978 PA 368,
MCL 333.16101 to 333.18838, or a facility licensed under article 17
of the public health code, 1978 PA 368, MCL 333.20101 to 333.22260,
shall not steal a prescription drug from that individual or
facility and sell that prescription drug to another person. A
person who violates this section is guilty of a felony punishable
by imprisonment for not more than 2 years or a fine of not more
than $5,000.00, or both. As used in this section, "prescription
drug" means that term as defined in section 17708 of the public
health code, 1978 PA 368, MCL 333.17708.
(2) This section does not prohibit a person from being charged
with, convicted of, or punished for any other violation of law that
is committed by that person while violating this section.
Enacting section 1. This amendatory act takes effect October
1, 2006.
