A bill to amend 1951 PA 51, entitled "An act to provide for the classification of all public roads, streets, and highways in this state, and for the revision of that classification and for additions to and deletions from each classification; to set up and establish the Michigan transportation fund; to provide for the deposits in the Michigan transportation fund of specific taxes on motor vehicles and motor vehicle fuels; to provide for the allocation of funds from the Michigan transportation fund and the use and administration of the fund for transportation purposes; to set up and establish the truck safety fund; to provide for the allocation of funds from the truck safety fund and administration of the fund for truck safety purposes; to set up and establish the Michigan truck safety commission; to establish certain standards for road contracts for certain businesses; to provide for the continuing review of transportation needs within the state; to authorize the state transportation commission, counties, cities, and villages to borrow money, issue bonds, and make pledges of funds for transportation purposes; to authorize counties to advance funds for the payment of deficiencies necessary for the payment of bonds issued under this act; to provide for the limitations, payment, retirement, and security of the bonds and pledges; to provide for appropriations and tax levies by counties and townships for county roads; to authorize contributions by townships for county roads; to provide for the establishment and administration of the state trunk line fund, local bridge fund, comprehensive transportation fund, and certain other funds; to provide for the deposits in the state trunk line fund, critical bridge fund, comprehensive transportation fund, and certain other funds of money raised by specific taxes and fees; to provide for definitions of public transportation functions and criteria; to define the purposes for which Michigan transportation funds may be allocated; to provide for Michigan transportation fund grants; to provide for review and approval of transportation programs; to provide for submission of annual legislative requests and reports; to provide for the establishment and functions of certain advisory entities; to provide for conditions for grants; to provide for the issuance of bonds and notes for transportation purposes; to provide for the powers and duties of certain state and local agencies and officials; to provide for the making of loans for transportation purposes by the state transportation department and for the receipt and repayment by local units and agencies of those loans from certain specified sources; and to repeal acts and parts of acts," by amending section 10k (MCL 247.660k), as amended by 1982 PA 438.

Whereas, For over thirty years in communities throughout the nation, local governments, non-profit agencies, and residents have developed a strong network of relationships to provide services to local communities and to develop projects to improve neighborhoods; and

Whereas, The state of Michigan has benefited from the community development partnerships and programs which have flourished due to the strong support of local governments and state agencies like the Michigan State Housing Development Authority; and

Whereas, Michigan community development partnerships and programs have created significant results in urban and rural communities, including after school programs, new and improved parks, neighborhood commercial revitalization projects, and over 5,000 housing units, of which nearly 2,000 are single family homes; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body recognize the week of March 28 through April 3, 2005, as National Community Development Week in the state of Michigan. We encourage all citizens to recognize and applaud the many contributions made by community development organizations and professionals to enhance the quality of life in this state by improving neighborhoods and low- and moderate-income residents.

House Resolution No. 40.

A resolution commemorating April 2005 as Raise the Flags and Dig Safely Month in the state of Michigan.

Whereas, The month of April, traditionally the beginning of the construction season, will be known as Raise the Flags and Dig Safely Month; and

Whereas, There continues to be steady construction activity in the state of Michigan. This construction activity has sometimes led to damages to underground facilities, which consist of cables, pipes, and lines located under the ground's surface. At times, these incidents have resulted in the loss of property and even serious injury to Michigan's citizens. Annually, there are thousands of recorded incidents of damages to underground facilities that occur in Michigan. Michigan's major gas, electric, and telecommunications companies, as well as other associated groups and the Michigan Public Service Commission, have worked together to develop and implement the best practices designed to decrease such incidents in the future; and

Whereas, The Raise the Flags campaign, sponsored by a utility consortium, is celebrating its fifth anniversary in 2005. The damage prevention program has been successful in helping to educate utility customers and the general public about safe digging, and has helped reduce accidents and damages to underground facilities. The program is recognized byMichigan's major gas and electric utilities such as Consumers Energy and DTE Energy, as well as other associated groups such as the Michigan Infrastructure and Transportation Association, Michigan Damage Prevention Board, MISS DIG System, Inc., and the Michigan Public Service Commission; and

Whereas, The Raise the Flags campaign has also demonstrated success in educating residents about the Michigan law that requires calling MISS DIG at least three working days before beginning a construction project. These projects can be as simple as planting a tree, installing a mailbox post or deck, and as complex as erecting an office building, residential home, or making major road repairs. The Raise the Flags campaign encourages contractors and the general public to call MISS DIG before digging, wait the required amount of time before digging, respect the staking flags, and then dig carefully; and

Whereas, We applaud the ongoing success of this program to educate Michigan residents on how to dig safely when undertaking construction projects; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body commemorate April 2005 as Raise the Flags and Dig Safely Month; and be it further

Resolved, That the parties involved in the Raise the Flags campaign be commended for coming together to find ways to decrease the number of incidents that damage underground facilities and reduce the risk of injury to Michigan citizens.
