A SUMMARY OF HOUSE BILL 4113 AS INTRODUCED 1-24-07

The bill would amend provisions in the Revised School Code that deal with the transfer of territory from one school district to another.  Under the code, affected resident landowners and local school boards can appeal a transfer-related action of an intermediate school district to the State Board of Education.  House Bill 4113 would instead require that appeals be made to the Circuit Court.  The scope of review of the court would be "de novo."  Appeals apply to the transfer of territory, the refusal to transfer territory, and accounting determinations.

FISCAL IMPACT:

The bill would have minimal, if any, fiscal impact by transferring administrative costs of appeals from the State Board of Education to circuit courts.
