A SUMMARY OF HOUSE BILL 6019 AS REPORTED FROM HOUSE COMMITTEE

Under the Public Health Code, a nursing home employee is required to report immediately any physical, mental, or emotional abuse, mistreatment, or harmful neglect of a patient to the nursing home administrator or nursing director.  House Bill 6019 would specifically allow the employee to report such patient mistreatment instead directly to the Department of Community Health.

Currently, a nursing home administrator or nursing director who becomes aware of patient mistreatment, abuse, or neglect must report the matter by telephone to the Department of Community Health and the DCH must notify the Department of Human Services.  Under House Bill 6019, upon receipt of a report of patient mistreatment or abuse by a nursing home administrator, nursing director, or an employee of a nursing home, the Department of Community Health would have to notify the nursing home at which the reported abuse or mistreatment is alleged to have occurred.

There are no local or state fiscal implications for House Bill 6019, a bill modifying the reporting requirements of abuse of a patient at a nursing home.
