A SUMMARY OF HOUSE BILL 6613 AS REPORTED FROM COMMITTEE
Under Section 11135 of the Natural Resources and Environmental Protection Act, businesses that generate hazardous waste must prepare a manifest and pay a $6 charge to the Department of Environmental Quality (DEQ) for each load of hazardous waste transported off site, payable annually on a fiscal year cycle. (The charges will expire on October 1, 2011.) House Bill 6613 would make these manifest processing charges payable on a calendar year cycle, as are annual handler user charges under Section 11153. To accomplish this transition, the 2009 billing cycle would cover manifests for October, November, and December 2007 and calendar year 2008. Thereafter, each cycle would cover a single calendar year.
The DEQ would now send out reporting forms for both the $6 per load manifest processing user charges and annual handler user charges (which are already on a calendar year cycle) by March 30 of each year, instead of by February 28.

FISCAL IMPACT:
This bill would shift the reporting period for hazardous waste manifest processing user charges from a fiscal year to a calendar year period. This bill would not have a fiscal impact on the state or on local governmental units.
