CONTENT
The bill would amend the Revised Judicature Act to postpone the scheduled decrease in Court of Appeals motion fees.
Currently, the fees are $200 for motions for immediate consideration and expedited appeal, and $100 for all other motions. The fees will decrease to $150 and $75, respectively, as of October 1, 2007. The bill would change that date to October 1, 2012. The fees were increased to the current rate in Public Act 138 of 2003, and the sunset was previously delayed in Public Act 151 of 2005.

FISCAL IMPACT
The increased rates for motion fees bring in an additional $87,500 annually. The Executive Recommendation and the Senate-passed version of the fiscal year 2007-08 judiciary budget assume the sunset will be extended and the revenue received. The revenue is used to fund Court of Appeals operations.
