CONTENT
The bill would amend the Weights and Measures Act to exclude liquefied petroleum gas (LPG) sold in Michigan from certain regulations regarding the method of sale.
Specifically, the Act requires the method of sale of a commodity sold in Michigan to conform to the "uniform regulation for the method of sale of commodities" in the 2002 edition of the National Institute of Standards and Technology (NIST) Handbook 130, except as otherwise provided.
Under the bill, the method of sale for LPG sold in Michigan would not have to conform to that regulation. The buying and selling of LPG could be conducted by the pound, gallon, metered cubic foot, or flat rate price, with the price rate clearly published and documented. Upon request by a customer, a retailer would have to disclose the actual pounds, gallons, or metered cubic feet included in the flat rate price.
The requirements described above would apply only to tanks of 100 pounds or less.
Under NIST Handbook 130, all liquefied petroleum gases, including propane, butane, and mixtures of those gases, must be sold by the pound, metered cubic foot of vapor, or the gallon. All metered sales by the gallon, except those using meters with a maximum rated capacity of 20 gallons per minute or less, must be made using a meter and device that automatically compensates for temperature.
