     A bill to make, supplement, and adjust appropriations for the

 

department of human services for the fiscal year ending September

 

30, 2009; and to provide for the expenditure of the appropriations.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

PART 1

 

LINE-ITEM APPROPRIATIONS

 

     Sec. 101. There is appropriated for the department of human

 

services to supplement appropriations for the fiscal year ending

 

September 30, 2009, from the following funds:

PART 2

 

PROVISIONS CONCERNING APPROPRIATIONS

 

GENERAL SECTIONS

 

     Sec. 201. In accordance with the provisions of section 30 of

 


article IX of the state constitution of 1963, total state spending

 

from state resources in this appropriation act for the fiscal year

 

ending September 30, 2009 is $13,286,600.00 and state

 

appropriations paid to local units of government are $5,227,400.00.

 

     Sec. 202. The appropriations authorized under this act are

 

subject to the management and budget act, 1984 PA 431, MCL 18.1101

 

to 18.1594. The itemized statement below identifies appropriations

 

from which spending to local units of government will occur:

 

DEPARTMENT OF HUMAN SERVICES

 

Child care fund........................................ $       5,227,400

     Sec. 203. (1) Beginning November 15, 2008, from the money

 

appropriated in part 1 for foster care payments and child care

 

fund, the department shall pay to private child placing agencies an

 

administrative rate of not less than $37.00 per day for foster care

 

services.

 

     (2) Beginning November 15, 2008, from the money appropriated

 

in part 1 for foster care payments and child care fund, the

 

department shall pay to each private residential service provider a

 

per diem rate that is $7.00 greater than the rate that provider

 

received in the fiscal year ending September 30, 2008.

 

     (3) It is the intent of the legislature that the

 

appropriations noted in this section be utilized to assist private

 

child placing agencies and private residential service providers in

 

complying with the requirements of sections VI, VII, and XII of the

 

settlement agreement in the case of Dwayne B., et al. v Granholm,

 

et al., United States eastern district court case no. 2:06-cv-

 


13548. Each private child placing agency and residential services

 

provider shall provide a letter to the department that gives

 

sufficient assurance that new funding from the rate increases was

 

used for this purpose. These letters shall be made available to the

 

legislature upon request.
