HOUSE BILL No. 5215

September 15, 2007, Introduced by Reps. Sak, Polidori, Emmons, Huizenga, Vagnozzi, Young, Agema, Brown, Espinoza, Lemmons, Ebli, Bauer, Angerer, Sheltrown, Garfield and Dean and referred to the Committee on Military and Veterans Affairs and Homeland Security.

 

     A bill to establish a board for the post-posthumous funds of

 

the Michigan veterans' facilities; and to provide for the

 

administration of the assets in the post-posthumous funds.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. This act shall be known and may be cited as the "post

 

and posthumous funds act".

 

     Sec. 2. The money on hand in the post fund and in the

 

posthumous fund of the Grand Rapids home for veterans and the D. J.

 

Jacobetti home for veterans in Marquette shall be administered by a

 

board established for each of the facilities.

 

     Sec. 3. Each board shall consist of 7 members. The composition

 

of each board shall be as follows:

 

     (a) One member who is the director of the department of

 


military and veterans affairs or his or her designee.

 

     (b) One member representing the board of managers for the

 

facility.

 

     (c) One member who is the activity director for the facility.

 

     (d) Four members who represent the facility, appointed by the

 

house council for each facility.

 

     Sec. 4. Disposition of the assets on hand in the post and

 

posthumous funds for each facility are acknowledged to be from

 

private sources and from donations, and determination of the

 

disposition of the assets in each fund shall be the sole province

 

of the board for each facility. The boards shall establish and

 

adopt procedures that the boards determine are necessary to

 

administer the assets for each facility.
