A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
by amending section 383a (MCL 750.383a).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec.
383a. Any A person or persons who shall wilfully not
willfully cut, break, obstruct, injure, destroy, tamper with or
manipulate, any
deface, or steal machinery, tools, equipment, a
telephone line or post, a telegraph line or post, an electric line,
a post, tower or supporting structures, an electric wire, an
insulator,
switch, or signal, a
natural gas pipe line pipeline,
a
water
pipe line pipeline, a steam heat pipe line pipeline
or the
valves or other appliances or equipment appertaining to or used in
connection
with such lines, or any other appliance whether herein
particularly
mentioned or not, being or
component of the electric
or
natural gas infrastructure that is the
property of any a
utility,
with the intention and without authority to interrupt, or
disrupt, or damage communications or electric, gas, water, or steam
heat
service, or to curtail or impair the utilization thereof, or
who
shall conspire, aid, abet in or cause to be done any such
unlawful
acts, shall be of those
services. A person who violates
this section is guilty of a felony punishable by imprisonment for
not more than 5 years or a fine of not more than $5,000.00, or
both. As
used in this section, "Utility "utility" includes any pipe
line
pipeline, gas, electric, heat, water, oil, sewer, telephone,
telegraph, radio, railway, railroad, airplane, transportation,
communication
or other system, by whomsoever whether
or not
publicly
owned, or that is operated
for the public use.
