HOUSE BILL No. 5506

     A bill to regulate the use of motor vehicles owned or leased

 

by a local unit of government or school district; and to prescribe

 

penalties.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. This act shall be known and may be cited as the "local

 

government motor vehicle regulation act".

 

     Sec. 3. As used in this act:

 

     (a) "Local unit of government" means a county, city, village,

 

township, or charter township.

 

     (b) "Motor vehicle" means a passenger vehicle, van, minibus,

 

bus, truck, or other motorized vehicle.

 

     (c) "Officer" includes, but is not limited to, the following:

 

     (i) School superintendent.

 

     (ii) School administrator.


 

     (d) "School district" means a local school district or

 

intermediate school district established under the revised school

 

code, 1976 PA 451, MCL 380.1 to 380.1852.

 

     Sec. 5. A motor vehicle owned or leased by a local unit of

 

government or school district shall not be used for personal use by

 

an officer or employee of the local unit of government or school

 

district.

 

     Sec. 7. (1) A local unit of government that does not comply

 

with the requirements of section 5 is subject to a reduction in

 

revenue sharing as provided in section 17b of the Glenn Steil state

 

revenue sharing act of 1971, 1971 PA 140, MCL 141.917b.

 

     (2) A school district that does not comply with the

 

requirements of section 5 is subject to a reduction in state aid as

 

provided in section 164f of the state school aid act of 1979, 1979

 

PA 94, MCL 388.1764f.

 

     Enacting section 1. This act does not take effect unless all

 

of the following bills of the 94th Legislature are enacted into

 

law:
