A bill to provide for compensation to certain members of the
military killed in active duty and payment to surviving spouses and
dependents in case of death arising from active duty; and to make
an appropriation.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. The surviving spouse or dependents of a member of the
military who is killed in action as the result of active duty shall
receive the sum of $10,000.00.
Sec. 2. (1) The amount provided for in this act shall be paid
from the general fund of the state treasury, from money
appropriated from the general fund.
(2) The attorney general shall review all claims under this
act and satisfy himself or herself of the merits of the claim
before authorizing payment.
Sec. 3. (1) This act applies only to the surviving spouse and
dependents, elective or appointive, of a member of the military who
is killed in action as the result of active duty.
(2) The sum of $10,000.00 is a total sum paid to the surviving
spouse and dependents and is not a sum that is paid to each
individual dependent. If the member of the military leaves a
surviving spouse, the entire sum shall be paid to the surviving
spouse. If there is no surviving spouse, the sum shall be divided
equally among the dependents. If there are no dependents, a sum of
$1,000.00 shall be paid to the estate of the member of the
military.
Sec. 4. As used in this act:
(a) "Dependent" means the children, parents, or siblings of
the member of the military if they depended on the member of the
military for food and shelter.
(b) "Member of the military" means a member of any component
of the state military establishment.
(c) "Surviving spouse" means the spouse of the member of the
military.
