     A bill to amend 1976 PA 174, entitled

 

"An act to provide free tuition for state resident North American

Indians in Michigan public community colleges, public universities,

and certain federal tribally controlled community colleges; and to

prescribe certain powers and duties of certain state departments,

commissions, and agencies,"

 

by amending section 2a (MCL 390.1252a).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 2a. (1) The Subject to subsection (3), the Michigan

 

commission on Indian Affairs affairs shall annually , upon

 

application therefore, reimburse each institution that applies for

 

reimbursement for the total amount of tuition waived during the

 

prior immediately preceding fiscal year under section 1. of this

 

act.

 

     (2) The commission shall report to the legislature annually


 

the number of American Indians for whom tuition has been waived at

 

each institution and the total amounts to be paid under this act.

 

     (3) Beginning in 2008, the commission shall reimburse under

 

subsection (1) only those institutions that consider a student

 

enrolled in that institution a resident of this state for

 

determining his or her tuition rates if the student is an active

 

duty member, or the spouse or dependent child of an active duty

 

member, of the armed forces of the United States, while that active

 

duty member is stationed in this state and during the student's

 

continuous full-time enrollment in the academic degree program in

 

which he or she is enrolled if that active duty member is

 

transferred to active duty outside of this state.
