“Father, in the name of Jesus we come before Your throne giving You glory, honor and praise. Lord, the word says that You ordered the steps of the righteous man. Father, everybody in this room, every elected member in this Chamber, and in the next Chamber, heavenly Father, everyone who is a staff member, we believe is called to be here and serve at this time. Father, open up the eyes of our enlightenment, help us understand heavenly Father, what it is that You would have us do. Lord God, I ask You move on people’s hearts. Help us yield to You and Your will, so we can continue to do the things that we need to do to move our state forward. I know that it is You, that empowers us to prosper. The word says in Psalms 11 that we would be like a tree planted by the river, we will produce. That is the destiny of the state of Michigan, heavenly Father. We will produce no matter what drought we think we see, heavenly Father. We’re always going to be fruitful in this state. So right now, I just ask You to help us continue to be mindful of that, Lord, and to guide our steps. We yield to You and we thank You for the leadership that You have put into our hearts. We just give You the glory, honor and praise, in Jesus’ name, Amen.”

Second Reading of Bills

House Bill No. 4751, entitled

A bill to provide for family military leave from employment for certain relatives of an individual called to active military service; to prohibit retaliation; and to prescribe remedies.

The bill was read a second time.

Rep. Amash moved to amend the bill as follows:

1. Amend page 1, following line 3, by inserting:

“(a) “Accrued leave time” means any accrued leave or compensatory time, excluding sick or disability leave.” and relettering the remaining subdivisions.

2. Amend page 2, line 27, by striking out all of subdivision (e) and inserting:

“Sec. 6. If an employee eligible for family military leave under section 5 has accrued leave time available, the employer may require the employee to use that accrued leave time and count the accrued leave time used toward the maximum family military leave time required under section 5.”.

3. Amend page 3, line 9, after “period.” by striking out “The” and inserting “Except as otherwise required for use of the employee’s accrued leave time, the”.

The motion did not prevail and the amendments were not adopted, a majority of the members serving not voting therefor.

Motions and Resolutions

House Resolution No. 91.

A resolution to memorialize the Congress of the United States to remove the requirement that states make permanent changes to their 100 percent employer-financed unemployment insurance laws to expand unemployment benefits to individuals who are not currently eligible in order to qualify for the state’s portion of one-time unemployment benefit funding.

Whereas, The Michigan Legislature recognizes the struggles Michigan’s unemployed workers are currently facing and has already taken swift action this year on legislative initiatives to allow displaced workers to receive up to 79 weeks of unemployment benefits and appropriated over $230 million in federal stimulus funds to assist jobless workers in finding employment and provide job training and career counseling to help individuals enter or reenter the workforce. This is in addition to the $25 weekly pay raise contained in the federal American Recovery and Reinvestment Act; and

Whereas, The American Recovery and Reinvestment Act also includes $7 billion in unemployment modernization funds. Of this, Michigan is eligible to receive $139 million in one-time funding if the state makes certain permanent changes to the statutes that govern its unemployment insurance program; and

Whereas, The one-time federal funds are extended to the states with the requirement that the statutory changes be permanent. The nonpartisan House Fiscal Agency estimates that any of these 4 options could cost tens of millions of dollars per year and become an unfunded mandate in as little as one or 2 years. Once one-time federal dollars are exhausted, job providers will be left to foot the bill through higher unemployment taxes, meaning the potential of additional job losses for Michigan workers; and

Whereas, While the appeal of any additional money from Washington at a time when Michigan and other states are experiencing high unemployment is alluring, the conditions that come with this funding hold significant long-term consequences and should be removed. Michigan’s unemployment system is already bankrupt, owing over $2 billion to the federal government. There are significant risks in taking on additional, permanent costs that will further strain the unemployment system and the ability of the state to fulfill its commitment to those workers who are currently eligible for unemployment checks; and

Whereas, The recession is a national issue that deserves a national solution. Michigan has the highest unemployment rate in the country. Our state needs immediate financial assistance from the federal government to aid jobless workers and their families. Congress should immediately distribute funds to Michigan without special conditions and pass legislation and appropriate funding to further aid the unemployed; and

Whereas, Michigan cannot afford the higher taxes that would lead to job cuts that accompany the current plan. Congress should do what is right and move quickly to allow states to access these funds without further delay, instead of placing costly mandates on receiving the funds; now, therefore, be it

Resolved by the House of Representatives, That we memorialize the Congress of the United States to remove the requirement that states make permanent changes to their 100 percent employer-financed unemployment insurance laws to expand unemployment benefits to individuals who are not currently eligible in order to qualify for the state’s portion of one-time unemployment benefit funding; and be it further

Resolved, That copies of this resolution be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.

Communications from State Officers

The following communication from the Department of Treasury was received and read:

May 4, 2009

Please find attached one copy of the Personal Property Audit Quarterly Report for the period January 1, 2009 - March 31, 2009. The report is required by Public Act 261of 2008, the General Government Appropriations Act. Section 947 of the Act provides, in part, as follows:

(1) Of the $4,749,200.00 included in part 1 for the revenue enhancement program, $4,249,200.00 shall be used for revenue collection enhancement activities including auditing functions.

(2) The department of treasury shall submit quarterly progress reports to the senate and house of representatives standing committees on appropriations subcommittees on general government and the senate and house fiscal agencies, regarding personal property tax audits funded under subsection (1). The report shall include the number of audits, revenue generated, and number of complaints received by the department related to the audits.
