“O Lord we pray to Thee for peace on earth...good will toward all.

We pray to Thee O Lord...in these troubled times…that those of us who have been honored with the opportunity to serve our citizens find a way to work together in a bi-partisan fashion for the good of people and not our respective parties.

Lord we have many important decisions to make…It has never been more important that we work together…We ask for Your wisdom and that You help guide us together through these troubled waters.

Together Lord we ask that You help us make the decisions that will create jobs for those that want to work to feed…to clothe…to shelter…and to educate their families…and we especially ask for Your guidance to help us bring an end to…home foreclosures for all our citizens and the families we serve.

Motions and Resolutions

The Speaker, on behalf of the entire membership of the House of Representatives, offered the following resolution:

House Resolution No. 92.

A resolution of tribute offered as a memorial for David Frederick Upton, former member of the House of Representatives.

Whereas, With the passing of David Frederick Upton, the southwestern region of Michigan and the entire state have suffered a genuine loss. As a leader in the business world, community service, and elected office, this unpretentious gentleman touched many lives and leaves a legacy of commitment to others that will long be cherished by all who knew him; and

Whereas, Born in Benton Harbor, David Upton was a man of great loyalty and integrity, traits fitting for the Eagle Scout he was. Like many of his generation, David Upton had his education, at the University of Michigan, interrupted by World War II. His distinguished service as a captain of an LST landing craft in the Pacific also put him on Iwo Jima as our flag was raised. Returning to civilian life, Mr. Upton finished his studies in Ann Arbor, began his career in business, and took on a variety of civic leadership roles in his home community; and

Whereas, Mr. Upton’s varied business experiences, which ranged from manufacturing to finance to the wine industry, and his involvement in education and public service groups, led him to elective responsibilities. With his service to the 1961-62 Constitutional Convention, he help craft Michigan’s fundamental law. Following that work with a term in the House of Representatives, Representative Upton was involved in the implementation of the constitution and the modernization of state law. His return to the business world was marked by accomplishment and a true passion for service and his family, as well as devotion to the Wolverines and to his beloved corner of our state. Clearly, this kind and unselfish man exerted an influence on others that will long endure; now, therefore, be it

Resolved by the House of Representatives, That we offer this expression of our highest tribute to honor the memory of David Frederick Upton, a member of this legislative body from 1963 to 1964 and a delegate of the 1961-62 Constitutional Convention; and be it further

Resolved, That copies of this resolution be transmitted to the Upton family as evidence of our lasting esteem for his memory.

House Bill No. 4867, entitled

A bill to amend 2007 PA 36, entitled “Michigan business tax act,” by amending sections 400, 403, and 413 (MCL 208.1400, 208.1403, and 208.1413), section 403 as amended by 2008 PA 434 and section 413 as amended by 2007 PA 145.

(The bill was read a third time and postponed for the day on May 7, see House Journal No. 39, p. 814.)

Senate Bill No. 409, entitled

A bill to amend 1994 PA 451, entitled “Natural resources and environmental protection act,” by amending section 43542 (MCL 324.43542), as added by 1995 PA 57.

1. Amend page 1, following line 6, by inserting:

(2) THE FEE FOR A MULTIYEAR LICENSE, PERMIT, OR APPLICATION SHALL BE THE ANNUAL FEE FOR THAT LICENSE, PERMIT, OR APPLICATION MULTIPLIED BY THE NUMBER OF YEARS DESIGNATED BY ORDER OF THE COMMISSION.” and renumbering the remaining subsection.

A resolution declaring June 24, 2009, as Older Michiganians Day in the state of Michigan.

Whereas, More than 1.8 million citizens age 60 and older make Michigan their home and deserve our utmost respect and gratitude for their many contributions to our communities and our state. Older citizens play a vital role in cities and towns all across our great state; and

Whereas, Older Michiganians are active supporters of Michigan’s economy, workforce, charities, religious institutions, local communities, and institutions of government. This group is one of our state’s greatest resources of understanding our past and improving our future. They are truly a foundation upon which we can build a better tomorrow; and

Whereas, This invaluable group of citizens is being honored and admired for their many contributions to the state of Michigan. They have are an indispensable source of knowledge and inspiration; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare June 24, 2009, as the Older Michiganians Day. A resolution recognizing June 2009 as Professional Pest Management Month in the state of Michigan.

Whereas, Effective pest management in homes, businesses, and public places throughout our state is an important factor in maintaining the health and well-being of all Michiganders; and

Whereas, Pest management professionals help protect Michigan’s food supply, homes, and the environment from disease and pest-related illnesses by practicing environmentally-friendly pest-control methods; and

Whereas, The Michigan Pest Management Association provides networking and leadership opportunities for Michigan’s pest management professionals and is recognized for its efforts to protect our environment as well as to ensure the safe and effective use of pest management materials; and

Whereas, The National Pest Management Association is committed to educating the public about the dangers posed by pests and the damage they can cause through its website, www.pestworld.org; and

Whereas, Pest Management Month offers all Michiganders an opportunity to understand and appreciate the important role that pest management providers play in ensuring the health and well-being of Michiganders; now, therefore, be it

House Resolution No. 95.

A resolution to commemorate May 16th, 2009, as Cherry Blossom Day in the state of Michigan.

Whereas, Michigan is the number one cherry producing state in the nation and is the unofficial Cherry Capitol of the World; and

Whereas, The United States produces about 650 million pounds of sweet and tart cherries each year, with Michigan producing the largest tart cherry crop. An average of 200 to 250 million pounds of tart cherries are harvested each year, an amount equal to 75 percent of the total crop; and

Whereas, A group of organizations including the Leelanau Enterprise, the Leelanau Conservation District, the Leelanau Conservancy, and the Grand Traverse Band of Ottawa and Chippewa Indians, is planning the Second Annual Leelanau Cherry Blossom Tour for Saturday, May 16th, in Leelanau County, which has more acres of tart cherry trees than any county in the nation; and

Whereas, Michigan also hosts the world largest cherry celebration, the National Cherry Festival, which takes place each July in Traverse City; and

Whereas, Cherries contain powerful antioxidants that may help fight cancer and heart disease and relieve the pain associated with arthritis and gout. Tart cherries are especially high in the antioxidant melatonin, which may help prevent or reduce brain deterioration associated with aging, and are also high in vitamin A and beta-carotene; and

Whereas, The average U.S. citizen consumes about one pound of tart cherries per year. That is more than 260 million pounds per year; and

Whereas, One of the most beautiful sites in Michigan or anywhere in the world during the month of May is the blossoming of the cherries trees; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body commemorate May 16th, 2009, as Cherry Blossom Day in the state of Michigan.

House Resolution No. 96.

A resolution recognizing May 2009 as Hearing Loss Awareness Month in the state of Michigan.

Whereas, Currently 31 million Americans have hearing loss. As baby boomers reach retirement age, starting in 2010, this number is expected to rapidly climb and nearly double by the year 2030; and

Whereas, It is estimated that 1.4 million people in the state of Michigan have hearing loss; and

Whereas, Among seniors, hearing loss is the third most treatable disabling condition behind arthritis and hypertension; and

Whereas, While 95 percent of people with hearing loss could be successfully treated with hearing aids and listening devices, only 22 percent currently use them; and

Whereas, Everyday approximately 3 in 1,000 newborns are born profoundly deaf or with a partial hearing loss making hearing loss the number one birth defect in America; and

Whereas, Hearing loss can greatly hinder everyday, ordinary communication, and people with a hearing loss often feel a sense of isolation and decreased self-confidence; and

Whereas, It is important that people with hearing loss in the state of Michigan be aware that there are many deaf/hard‑of-hearing organizations, audiologists and hearing professionals, assistive listening device manufacturers, and support groups that offer a large range of solutions to help people with hearing loss; now, therefore, be it further

Resolved by the House of Representatives, That the members of this legislative body recognize May 2009 as Hearing Loss Awareness Month in the state of Michigan.
