“An act to revise, consolidate, and classify the laws relating to the insurance and surety business; to regulate the incorporation or formation of domestic insurance and surety companies and associations and the admission of foreign and alien companies and associations; to provide their rights, powers, and immunities and to prescribe the conditions on which companies and associations organized, existing, or authorized under this act may exercise their powers; to provide the rights, powers, and immunities and to prescribe the conditions on which other persons, firms, corporations, associations, risk retention groups, and purchasing groups engaged in an insurance or surety business may exercise their powers; to provide for the imposition of a privilege fee on domestic insurance companies and associations and the state accident fund; to provide for the imposition of a tax on the business of foreign and alien companies and associations; to provide for the imposition of a tax on risk retention groups and purchasing groups; to provide for the imposition of a tax on the business of surplus line agents; to provide for the imposition of regulatory fees on certain insurers; to provide for assessment fees on certain health maintenance organizations; to modify tort liability arising out of certain accidents; to provide for limited actions with respect to that modified tort liability and to prescribe certain procedures for maintaining those actions; to require security for losses arising out of certain accidents; to provide for the continued availability and affordability of automobile insurance and homeowners insurance in this state and to facilitate the purchase of that insurance by all residents of this state at fair and reasonable rates; to provide for certain reporting with respect to insurance and with respect to certain claims against uninsured or self-insured persons; to prescribe duties for certain state departments and officers with respect to that reporting; to provide for certain assessments; to establish and continue certain state insurance funds; to modify and clarify the status, rights, powers, duties, and operations of the nonprofit malpractice insurance fund; to provide for the departmental supervision and regulation of the insurance and surety business within this state; to provide for regulation over worker’s compensation self-insurers; to provide for the conservation, rehabilitation, or liquidation of unsound or insolvent insurers; to provide for the protection of policyholders, claimants, and creditors of unsound or insolvent insurers; to provide for associations of insurers to protect policyholders and claimants in the event of insurer insolvencies; to prescribe educational requirements for insurance agents and solicitors; to provide for the regulation of multiple employer welfare arrangements; to create an automobile theft prevention authority to reduce the number of automobile thefts in this state; to prescribe the powers and duties of the automobile theft prevention authority; to provide certain powers and duties upon certain officials, departments, and authorities of this state; to provide for an appropriation; to repeal acts and parts of acts; and to provide penalties for the violation of this act,”

A resolution honoring Robert Heft, the designer of the United States 50-star flag.

Whereas, Robert “Bob” G. Heft was born in Saginaw, Michigan in 1942. He was the designer of the 50-star flag, and has one of the proposed designs for a 51-star flag for the United States of America; and

Whereas, He designed the current United States flag in 1958 while living with his grandparents in Lancaster, Ohio. He was 17-years-old at the time and did the flag design as a class project. He unstitched the blue field from a family 48-star flag, sewed in a new field, and used iron-on white fabric to add 100 hand-cut stars, 50 on each side of the blue canton; and

Whereas, He originally received a B- for the project. After discussing the grade with his high school teacher, Stanley Pratt, it was agreed that if the flag was accepted by Congress, the grade would be reconsidered. Heft’s flag design was chosen and adopted by presidential proclamation after Alaska and before Hawaii were admitted into the union in 1959. According to Heft, his teacher kept to their agreement and changed his grade to an A for the project; and

Whereas, When Alaska and Hawaii were being considered for statehood, more than 1,500 designs were spontaneously submitted to President Dwight D. Eisenhower by Americans all over the country. Although some of them were 49-star versions, the vast majority were 50-star proposals. At least three, and probably more, of these designs were identical to the present design of the 50-star flag. These designs are in the Eisenhower Presidential Archives in Abilene, Kansas. Only a small fraction of them have ever been published; and

Whereas, After graduating from college, Heft became a high school teacher and later a college professor, and he also served as mayor of Napoleon, Ohio for 28 years. After retiring from teaching, he became a motivational speaker. Heft was a longtime member of the Harvey Spaulding Toastmasters Club in Saginaw. He earned the nickname “father time” as he often filled the role of timer during meetings. While he was seen as one of their own, other members of the club were always honored when Heft would deliver a speech at a meeting; now, therefore, be it

Resolved by the House of Representatives, That the members of the legislative body honor Robert Heft, the designer of the United States 50-star flag, who died on December 12, 2009.

House Resolution No. 191.

A resolution to urge the United States Department of State to fulfill its legal obligation to respond to Freedom of Information requests for records related to breaches in passport record security and to provide complete information to the states regarding how Enhanced Driver’s License information is being protected, housed, and shared.

Whereas, The integrity and security of personal identification information must be a top priority of governmental agencies and offices. Identity theft in our age of instant and international communications is a crime with ramifications we are only beginning to fully comprehend. This crime threatens not only every individual, business, and family, but also our national security; and

Whereas, The American public’s faith in the treatment of personal information was shaken by recurring reports in the 2008 presidential campaign that passport records of major candidates had been inappropriately accessed. Information on even Hilary Clinton, John McCain, and Barack Obama was accessed improperly, leaving citizens to wonder whether their records would even be held to the same standard. In addition, news reports from last year showed security breaches in passport components being produced overseas, including the theft or loss of blank radio frequency identification chips. Numerous reports issued by the Governmental Accountability Office have been critical as well. The fact the federal government would now like states to issue state driver’s license federal passport hybrids known as Enhanced Driver’s Licenses (EDLs) means that states have an even more vested interest in knowing if the breaches are truly being fixed, who is maintaining the databases, and what kinds of personal or biometric data is being shared with foreign governments; and

Whereas, In response to this serious situation, Freedom of Information requests were submitted in an effort to determine whether the federal government is taking steps necessary to improve the situation and so that states can determine if the citizen data they are entrusting to the federal government is being adequately safeguarded. However, the records ultimately released by the United States Department of State included a report that was highly redacted, and even state elected officials are having difficulty getting information. Although the report of the State Department’s Office of the Inspector General showed extensive evidence that many files had been compromised, the amount of withheld information raised additional concerns. Only 6 of the report’s 22 recommendations were not completely redacted. This has led to questions over whether protocols are being followed and additional requests for more complete information, as well as a lawsuit after the request was denied; and

Whereas, The issues at stake in this situation have far more significance than isolated violations of security policies related to certain passport files. The issues include the increasing use of nongovernmental employees, portable laptops, and foreign contractors from countries actively involved in espionage against the United States; now, therefore, be it

Resolved by the House of Representatives, That we urge the United States Department of State to fulfill its legal obligation to respond to Freedom of Information requests for records related to breaches in passport record security and, additionally, to provide complete information to the states regarding how Enhanced Driver’s License (EDL) information is being protected, housed, and shared; and be it further

House Concurrent Resolution No. 36.

A concurrent resolution to memorialize the United States Congress to embrace greater economic transparency by enacting H.R. 1207, the Federal Reserve Transparency Act of 2009, and to enact it as a stand alone bill not attached to other legislation and in a version fully supported by the bill’s original sponsors.

Whereas, The Federal Reserve System is responsible for our nation’s monetary policy, banking regulation, consumer protection, and a host of related financial services, including acting as a central bank for the United States. As a quasi-public, quasi-private institution it has historically enjoyed considerable independence from congressional oversight and public scrutiny; and

Whereas, The importance of the Federal Reserve System’s decision-making processes that shape the U.S. financial climate have become magnified as world economies have grown, become more interlinked, and become much more complex. In addition, various proposals have sought to expand the central bank’s regulatory authority beyond its current role; and

Whereas, It is clear in the wake of the current financial crisis that more transparency is needed in the financial system, and, despite the Federal Reserve’s quasi-private status, that it be subject to audits by the Government Accountability Office to ensure that central bank practices are serving their intended purposes for the American public; and

Whereas, Legislation currently before Congress, the Federal Reserve Transparency Act of 2009 (H.R. 1207), would require the Comptroller General of the United States to audit the Board of Governors of the Federal Reserve System before the end of 2010 and submit its findings and recommendations for legislation, if deemed to be necessary, to the United States Congress within 90 days. This vital measure is essential to our nation’s financial well-being and future, and would go a long way in reassuring the public of the stability of our banking and financial network. Nonetheless, despite its broad support, Congress is attaching this legislation to other bills placing legislators in a position where they must also adopt controversial legislation in order to pass the common sense and urgently needed policies of H.R. 1207; now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That we hereby memorialize the United States Congress to enact H.R. 1207, the Federal Reserve Transparency Act of 2009, and to enact it as a stand alone bill not attached to other legislation and in a version fully supported by the bill’s original sponsors; and be it further
