“An act to provide for the registration, titling, sale, transfer, and regulation of certain vehicles operated upon the public highways of this state or any other place open to the general public or generally accessible to motor vehicles and distressed vehicles; to provide for the licensing of dealers; to provide for the examination, licensing, and control of operators and chauffeurs; to provide for the giving of proof of financial responsibility and security by owners and operators of vehicles; to provide for the imposition, levy, and collection of specific taxes on vehicles, and the levy and collection of sales and use taxes, license fees, and permit fees; to provide for the regulation and use of streets and highways; to create certain funds; to provide penalties and sanctions for a violation of this act; to provide for civil liability of owners and operators of vehicles and service of process on residents and nonresidents; to regulate the introduction and use of certain evidence; to provide for the levy of certain assessments; to provide for the enforcement of this act; to provide for the creation of and to prescribe the powers and duties of certain state and local agencies; to impose liability upon the state or local agencies; to provide appropriations for certain purposes; to repeal all other acts or parts of acts inconsistent with this act or contrary to this act; and to repeal certain parts of this act on a specific date,”.

Senator Birkholz’s statement is as follows:

This bill is the bill that deals with the interlock system for repeat drunk drivers. As many people in this body know, drunk driving remains a serious issue in Michigan. What many people forget is that when someone gets caught driving while drunk, the odds are that alcohol abuse and addiction have ramifications throughout their family, community, creditors, employers, children, friends, etc.

Over the last few years, we have done a good job of reducing injuries and deaths associated with impaired driving. This bill and the others in the package begin challenging us at the task of addressing the addiction that leads to drunk driving in the first place.

Judge Harvey Hoffman of Eaton County is a national leader in the sobriety court and drug treatment court movement. He has presented at conferences nationally and internationally. As he testified in our committee, between the loss of driving rights and the fairly-high financial sanctions for impaired driving, he said, “We have created an unlicensed, uninsured, untreated, and dangerous underclass of alcoholic drivers in our state.

These bills will begin to change that. They would allow an alcohol-addicted driver to drive once again with a restricted license, as long as there was an ignition interlock system installed on every car that the driver would have access to. Then they would be able to get their license, but the interlock ignition would check their BAC before they drive, while they were driving, and even during the day while they were not driving. If they were to violate while driving, they would have five minutes to find a safe spot to pull over, and then the system would automatically shut down their vehicle. The authorities would then have to reset the ignition interlock.

The BAC level would be randomly checked during the day, even when not driving, to ensure that they would not be drinking. The driver would have 24 hours to report to authorities, or if their car refused to start and run, they would then have to report to the appropriate authorities.

Colleagues, these bills will help deal with a real-life solution to a real-life problem. The amendment that we put in the bill this morning helps deal with the technical change that all of the stakeholders have agreed to. I urge your support for this bill and the others in the package when they are returned from the House.

Senator Scott’s statement is as follows:

Religion scholar Roy L. Smith said, “Each morning puts us on trial and each evening passes judgment.” Unless we take action later today in committee, we will be judged wanting at the end of this day because we will once again fail to have acted on auto insurance reform.

In our current economy, just about everyone is struggling to keep on top of their bills. Nearly everyone has seen their savings accounts, their retirement accounts, and their paychecks shrink. But our bills don’t shrink along with our available money. In Michigan, people don’t have the option of ignoring their car insurance bill unless they want to break the law.

You and I could shrink that bill for our constituents if we would take action on auto insurance reform. Too many Michigan citizens are paying far more than they should to insure their cars. We need to reform auto insurance now, so that at the end of the day, we know we will be judged well on our actions because we will have done what is needed for the people of this great state.
