Senate Bill 1247 (as introduced 3-25-10)
Sponsor: Senator Gerald Van Woerkom
Committee: Natural Resources and Environmental Affairs

Date Completed: 11-2-10

CONTENT The bill would repeal Section 3111 of the Natural Resources and Environmental Protection Act, which requires certain people to file with the Department of Natural Resources and Environment (DNRE) an annual report regarding wastewater discharges.

Under Section 3111, if a person doing business in Michigan discharges into the State's waters, or to any sewer system, wastewater that contains waste in addition to sanitary sewage, the person must file an annual report with the DNRE. The report must set forth the nature of the enterprise, indicating the quantities of materials used in and incidental to its manufacturing processes, including by-products and waste products that appear on the DNRE's register of critical materials and the estimated annual total number of gallons of wastewater.

The DNRE may use the information only for purposes of water pollution control, and must provide proper and adequate facilities and procedures to safeguard the confidentiality of manufacturing proprietary processes, subject to an exception for waste products discharged to the waters of the State.

Operations of a business or industry that violate Section 3111 may be enjoined by an action commenced by the Attorney General.

The DNRE must promulgate rules necessary for the administration of Section 3111.
