SUBSTITUTE FOR

 

SENATE BILL NO. 1138

 

 

 

 

 

 

 

 

 

 

 

     A bill to amend 1879 PA 248, entitled

 

"An act to prevent animals from running at large in certain cities

and villages within this state,"

 

by amending section 1 (MCL 433.51) and by adding section 13.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. That it shall not be lawful for any cattle, horses,

 

mules, sheep, swine, or goats The owner of any cattle, horse, mule,

 

sheep, swine, or goat shall not allow the animal to run at large in

 

any public street, lane, alley, park, place , or highway, in any

 

city or village within this state, having a population of 7,000 or

 

more inhabitants. ; and it shall be the duty of every commissioner

 

of highways, poundmaster, marshal, deputy marshal, policeman and

 

constable of any such A law enforcement officer of or animal

 

control officer for such a city or village , to may seize, and take

 

into his possession as herein provided, and keep until disposed of


 

according to law, any as provided under this act, any such animal

 

so found running at large. , Provided The city of Ludington be

 

exempt from the operations of this act.

 

     Sec. 13. This act does not limit authority provided under

 

section 4a of 1976 PA 328, MCL 433.14a, to kill swine running at

 

large. Swine running at large are a public nuisance.

 

     Enacting section 1. This amendatory act does not take effect

 

unless House Bill No. 5822 of the 95th Legislature is enacted into

 

law.
