A bill to provide for the imposition of certain sanctions for
falsely selling certain farm products.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. As used in this act, "farm product" means those plants
useful to human beings produced by agriculture and includes, but is
not limited to, forages and sod crops, grains and feed crops, field
crops, bees and bee products, berries, herbs, fruits, vegetables,
flowers, seeds, grasses, nursery stock, trees and tree products,
mushrooms, and other similar products, or any other product which
incorporates the use of food, feed, or fiber.
Sec. 2. A person shall not sell, offer for sale, or advertise
for sale a farm product that is designated, by sign or packaging,
as locally grown or produced unless the farm product is grown or
produced, respectively, 100 miles or less from the location of
sale. The prohibition contained in this section applies only to the
person actually selling, offering for sale, or advertising the farm
product as locally grown and does not apply to a producer who
supplied that farm product to the ultimate seller.
Sec. 3. A person that violates this act is responsible for a
state civil infraction and may be ordered to pay a civil fine of
not more than $500.00.
