A SUMMARY OF HOUSE BILL 4360 AS REPORTED FROM COMMITTEE ON 5-4-11

The Motor Carrier Safety Act of 1963 specifies that the act and the rules promulgated under the act do not apply to a school bus as defined in the Pupil Transportation Act.  House Bill 4360 would add, "except for the purpose of granting a waiver in accordance with Section 53 of the Pupil Transportation Act."  This refers to a waiver for a school bus driver with diabetes.

Section 53 of the Pupil Transportation Act was amended in the 2009-2010 legislative session so that certain school bus drivers could be exempt from a regulation under the Code of Federal Regulations that requires drivers to have no established medical history or clinical diagnosis of diabetes mellitus currently requiring insulin for control.  Public Act 93 of 2010 (House Bill 5363) said an exception could be granted to an individual who had been granted a waiver under the Motor Carrier Safety Act or one who was employed as a bus driver on the effective date of PA 93 and met certain specified other requirements.  Section 3 of the Motor Carrier Act allows waivers by the State Police and the Motor Carrier Safety Appeal Board of certain physical or medical qualification requirements.

House Bill 4360 appears to make a complementary amendment to the Motor Carrier Safety Act to make reference to that waiver.
