     A bill to amend 1976 PA 451, entitled

 

"The revised school code,"

 

(MCL 380.1 to 380.1852) by adding sections 1180, 1181, 1182, and

 

1183.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1180. (1) Not later than 6 months after the effective

 

date of this section, the board of a school district or

 

intermediate school district or board of directors of a public

 

school academy shall adopt and implement a policy for the handling

 

of medical emergencies that occur at school. School districts,

 

intermediate school districts, and public school academies are

 

encouraged to work with local emergency medical first responders to

 

ensure that first responders have access to detailed information on

 

and are familiar with the layout for each school. The detailed

 

information shall include a designated emergency entrance where


 

employees of the school can direct the emergency medical first

 

responders to the appropriate location in the school building.

 

     (2) The board of a school district or intermediate school

 

district or board of directors of a public school academy shall

 

post on its website and update at least annually all of the

 

following information:

 

     (a) The total number of instructional staff members working at

 

each school operated by the board or board of directors.

 

     (b) The total number of instructional staff members working at

 

each school operated by the board or board of directors who hold

 

valid certification in cardiopulmonary resuscitation issued by the

 

American Red Cross, American heart association, or a comparable

 

organization.

 

     (3) School districts, intermediate school districts, and

 

public school academies are encouraged to work with the American

 

Red Cross, American heart association, health care providers, or

 

other cardiopulmonary resuscitation training providers to obtain

 

training in cardiopulmonary resuscitation for staff and pupils.

 

     (4) As used in this section, "at school" means that term as

 

defined in section 1308.

 

     Sec. 1181. Beginning September 1, 2012, except as otherwise

 

provided in subsection (2), the board of a school district or

 

intermediate school district or board of directors of a public

 

school academy shall ensure that each individual that the school

 

district, intermediate school district, or public school academy

 

employs or assigns to work in physical education or athletics at a

 

school that it operates has successfully completed a course


 

approved by the department in first aid and cardiopulmonary

 

resuscitation, including a test demonstration on a mannequin; has

 

successfully completed instruction approved by the department in

 

foreign body airway obstruction management; and holds valid

 

certification in these topics issued by the American Red Cross,

 

American heart association, or a comparable organization or

 

institution approved by the department. A school district,

 

intermediate school district, or public school academy shall

 

provide the training necessary for compliance with this subsection

 

or shall arrange for the provision of this training at no cost to

 

the individuals receiving the training.

 

     (2) Subsection (1) does not apply to an individual employed or

 

assigned to work in physical education or athletics if the

 

individual has physical limitations that make it impracticable for

 

the individual to complete the training and obtain the required

 

certification under subsection (1).

 

     (3) The legislature shall appropriate funds as necessary to

 

reimburse school districts, intermediate school districts, and

 

public school academies for the costs of the training and

 

certification required under subsection (1).

 

     (4) As used in this section, "work in physical education or

 

athletics" means to be employed as a teacher or aide for physical

 

education or to act as a coach, trainer, or other member of the

 

staff for an interscholastic athletics team, contest, competition,

 

tournament, meet, or practice.

 

     Sec. 1182. Beginning September 1, 2012, the board of a school

 

district or intermediate school district or board of directors of a


 

public school academy shall ensure that the school district,

 

intermediate school district, or public school academy maintains in

 

a secure manner for each pupil all of the following:

 

     (a) Emergency contact information.

 

     (b) Medical background and history.

 

     Sec. 1183. Beginning September 1, 2012, the board of a school

 

district or intermediate school district or board of directors of a

 

public school academy shall ensure all of the following:

 

     (a) That an automated external defibrillator is present at

 

each public school it operates and that the automated external

 

defibrillator is readily accessible during school hours to staff,

 

pupils, volunteers, and guests.

 

      (b) That an automated external defibrillator is present and

 

readily accessible within 50 feet of any athletic activity or event

 

sponsored or permitted by the school district, intermediate school

 

district, or public school academy.
