ENROLLED HOUSE BILL No. 5121
AN ACT to amend 1961 PA 236, entitled “An act to revise and consolidate the statutes relating to the organization and jurisdiction of the courts of this state; the powers and duties of the courts, and of the judges and other officers of the courts; the forms and attributes of civil claims and actions; the time within which civil actions and proceedings may be brought in the courts; pleading, evidence, practice, and procedure in civil and criminal actions and proceedings in the courts; to provide for the powers and duties of certain state governmental officers and entities; to provide remedies and penalties for the violation of certain provisions of this act; to repeal all acts and parts of acts inconsistent with or contravening any of the provisions of this act; and to repeal acts and parts of acts,” by amending section 517 (MCL 600.517), as amended by 2009 PA 228.
The People of the State of Michigan enact:
Sec. 517. (1) The sixteenth judicial circuit consists of the county of Macomb and, except as otherwise provided in this section, has 13 judges.
(2) Subject to section 550, this circuit has 12 judges during the period beginning 12 noon, January 1, 2011 and ending 12 noon, January 1, 2017. The 1 judgeship temporarily eliminated from this circuit during the period of January 1, 2011 to January 1, 2017 shall be the judgeship of a judge who is not eligible to run for reelection due to constitutional limitation on January 5, 2010.
(3) Subject to section 550, this judicial circuit may have 1 additional judge beginning January 1, 2017.
(4) Subject to section 550, this judicial circuit may have 1 additional judge beginning January 1, 2019. If this new judgeship is added to the sixteenth judicial circuit, the initial term of office of the judgeship shall be 8 years.
Enacting section 1. This amendatory act does not take effect unless the following bills of the 97th Legislature are enacted into law:
(a) House Bill No. 5122.
(b) House Bill No. 5123.
(c) House Bill No. 5124.
(d) House Bill No. 5125.
This act is ordered to take immediate effect.
