CONTENT

 

The bill would amend the Michigan Adoption Code to delete language under which filing an adoption petition in the county where parental rights were terminated is limited to situations in which the petitioner and adoptee live out of State. Currently, the Code requires an adoption petition to be filed with the court of the county in which the petitioner resides, where the adoptee is found, or, if the petitioner and the adoptee reside out of State, where the parent's parental rights were terminated or are pending termination.

 

The Code also provides that if an adoption petition is filed in a county other than that in which the petitioner lives or the adoptee is found, the chief judge of the court may, upon motion, enter an order transferring jurisdiction to the court of the county where the petitioner lives or the adoptee is found. The bill would delete that provision.
