SUBSTITUTE FOR

SENATE BILL NO. 401

     A bill to amend 2010 PA 296, entitled

"Art institute authorities act,"

(MCL 123.1201 to 123.1229) by amending the title and by adding

section 31.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

TITLE

     An act to provide for the establishment of art institute

authorities; to provide for the powers and duties of an art

institute authority and art institutes; to authorize the levy and

collection of a property tax by an art institute authority; and to

provide for the powers and duties of certain government officials.

     Sec. 31. (1) An art institute may not deaccession from its

collection or sell, lease, pledge, mortgage, or otherwise encumber

art that is accessioned to or otherwise held in the collection of

the art institute except in accordance with the code of ethics for

museums published by the American alliance of museums or a

successor organization.

     (2) A facility owned by a municipality in which the primary

art collection of an art institute is exhibited shall be used

principally to exhibit, preserve, and maintain the art collection;

may not be leased, pledged, mortgaged, or otherwise encumbered; and

may not be sold unless the sale is in connection with the

relocation of the art collection to a comparable facility within

the same municipality.
