A bill to provide for the management, operations, maintenance,
restoration, and improvement of the state's official residences;
and to prescribe the powers and duties of certain state agencies
and officials.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. This act shall be known and may be cited as the
"official residences act".
Sec. 2. As used in this act:
(a) "Captain's and major's quarters" means the buildings and
grounds on Mackinac Island bounded on the north by Huron street,
bounded on the west by Fort street, bounded on the south by the
north Fort Wall, and bounded on the east by a north-south line a
distance of 420 feet east of the intersection of Fort street and
Huron street.
(b) "Commission" means the official residences commission
established in section 4.
(c) "Department" means the department of technology,
management, and budget.
(d) "Fund" means the official residences fund created in
section 6.
(e) "Lansing residence" means the governor's residence and
grounds in Lansing bounded by Oxford road on the south, Nottingham
road on the west, Moores river drive on the north, and lots 2 and
12 of Riverside homes company subdivision no. 1 on the east.
(f) "Mackinac residence" means the governor's Mackinac Island
residence and grounds encompassing approximately 16 acres in the
Mackinac Island state park, located on the west lot at the top of
Fort hill, and bounded by Fort street on the north and Spring
street on the south.
(g) "Official residences" means all of the following:
(i) The Lansing residence.
(ii) The Mackinac residence.
(iii) The captain's and major's quarters.
(h) "Person" means an individual, partnership, corporation,
association, governmental entity, or other legal entity.
Sec. 3. The official residences and the grounds of the
official residences shall be under the exclusive control of the
commission.
Sec. 4. (1) The official residences commission is established.
(2) The commission shall consist of the following members:
(a) The director of the department or his or her designee.
(b) Two individuals appointed by the governor, at least 1 of
whom has expertise and experience in operations, maintenance, or
restoration of historic structures.
(3) Members of the commission shall serve without
compensation. However, members of the commission may be reimbursed
for their actual and necessary expenses incurred in the performance
of their official duties as members of the commission.
(4) A majority of the members of the commission constitute a
quorum for the transaction of business at a meeting of the
commission. An affirmative vote of a majority of the members of the
commission is required for official action of the commission.
(5) The business that the commission may perform shall be
conducted at a public meeting of the commission held in compliance
with the open meetings act, 1976 PA 267, MCL 15.261 to 15.275.
(6) A writing prepared, owned, used, in the possession of, or
retained by the commission in the performance of an official
function is subject to the freedom of information act, 1976 PA 442,
MCL 15.231 to 15.246.
Sec. 5. (1) The commission shall do all of the following:
(a) Operate and manage the official residences.
(b) Maintain, restore, and improve the official residences.
(c) Maintain and improve the grounds of the official
residences.
(d) Contract with any person for purposes of procuring goods
or services or otherwise carrying out the commission's
responsibilities with regard to the official residences and the
grounds of the official residences.
(e) Make recommendations to the governor, the senate, and the
house of representatives regarding funding for the official
residences and the grounds of the official residences, including,
but not limited to, funding from the fund.
(f) Carry out other responsibilities as provided by law.
(2) The department shall provide staff to the commission to
carry out the commission's responsibilities under subsection (1).
Sec. 6. (1) The official residences fund is created within the
state treasury.
(2) The state treasurer may receive money or other assets from
any source for deposit into the fund, including private gifts,
bequests, and donations. The state treasurer shall direct the
investment of the fund. The state treasurer shall credit to the
fund interest and earnings from fund investments.
(3) Except as provided in this subsection, money in the fund
at the close of the fiscal year shall remain in the fund and shall
not lapse to the general fund. If, at the close of any state fiscal
year, money in the fund exceeds $1,500,000.00, any amount in excess
of $1,500,000.00 shall lapse to the general fund.
(4) The commission shall be the administrator of the fund for
auditing purposes.
(5) The commission shall expend money from the fund to carry
out its responsibilities under this act.
Enacting section 1. This act does not take effect unless
Senate Bill No. 804
of the 97th Legislature is enacted into law.
