“Almighty, wise and loving God,

As these women and men gather to carry out the business of governing, I pray for Your presence to fill this place.

Their task is daunting for the people they represent are from every income level, diverse religious beliefs, ethnicity, and gender. The needs they are addressing today are as varied as the people they represent.

I pray that You would be with them to guide them towards wise decisions. I pray that civility would be the mark of their discussions.

I pray, Almighty God, that this gathered body would conduct business in an honorable way. I pray they would do so justly and with grace, wisdom, and humility.

I pray this in the name of the great lover of all humanity, Jesus Christ. Amen.”

Motions and Resolutions

Reps. McMillin, Kelly, Lauwers, Graves, Daley, Howrylak, Franz, Heise, Hooker and MacMaster offered the following resolution:

House Resolution No. 91.

A resolution to urge Congress to continue to investigate and determine what happened in Benghazi on September 11, 2012.

Whereas, On September 11, 2012, armed militants attacked the U.S. consulate and a CIA annex in Benghazi, Libya. The U.S. ambassador and three other Americans were killed in the terrorist attack, and an unknown number of survivors wounded; and

Whereas, The Obama administration initially reported to the American people that the attack was the result of a spontaneous riot instigated by protests over an anti-Islamic film. Later, it was revealed that there was no evidence of a riot and clear evidence that the attack was premeditated. The exact events of that day and the nature of the U.S. operations in Libya still remain a mystery; and

Whereas, The President and key members of his administration continue to impede a thorough congressional investigation into this tragedy. Despite requests, the administration has denied Congress information about the survivors or an opportunity to interview them; and

Whereas, The American people deserve to know the truth about what happened that day and the administration’s response. Our nation’s trust in our government and its elected leaders is shaken at its foundation without transparency and accountability; now, therefore, be it

Resolved by the House of Representatives, That we urge Congress to continue to investigate and determine what happened in Benghazi on September 11, 2012; and be it further

Resolved, That copies of this resolution be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.

House Resolution No. 92.

A resolution to declare April 11, 2013, as Parkinson’s Disease Awareness Day in the state of Michigan.

Whereas, Parkinson’s disease is the second most common neurodegenerative disease in the United States, second only to Alzheimer’s disease; and

Whereas, There is inadequate comprehensive data on the incidence and prevalence of Parkinson’s disease. As of 2011, it is estimated that the disease affects from 500,000 to 1,500,000 people in the United States; and

Whereas, Although research suggests the cause of Parkinson’s disease is a combination of genetic and environmental factors, the exact cause and progression of the disease is still unknown; and

Whereas, There is no objective test for Parkinson’s disease and the rate of misdiagnosis can be high; and

Whereas, Symptoms of Parkinson’s disease vary from person to person and include tremors, slowness, poor balance, trouble swallowing or chewing, cognitive problems, dementia, mood disorders, sleep disruptions, and more; and

Whereas, Medications can help ease the symptoms for a limited amount of time each day, but typically lose their effectiveness after 4 to 8 years, leaving the person unable to move, speak, or swallow; and

Whereas, There is no cure, therapy, or drug to slow or stop the progression of Parkinson’s disease; and

Whereas, Increased education and research are needed to help find more effective treatments with fewer side effects and, ultimately, an effective cure for Parkinson’s disease; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare April 11, 2013, as Parkinson’s Disease Awareness Day in the state of Michigan. We support the search for a cure.

House Bill No. 4002, entitled

A bill to amend 1941 PA 122, entitled “An act to establish the revenue collection duties of the department of treasury; to prescribe its powers and duties as the revenue collection agency of this state; to prescribe certain powers and duties of the state treasurer; to establish the collection duties of certain other state departments for money or accounts owed to this state; to regulate the importation, stamping, and disposition of certain tobacco products; to provide for the transfer of powers and duties now vested in certain other state boards, commissions, departments, and offices; to prescribe certain duties of and require certain reports from the department of treasury; to provide procedures for the payment, administration, audit, assessment, levy of interests or penalties on, and appeals of taxes and tax liability; to prescribe its powers and duties if an agreement to act as agent for a city to administer, collect, and enforce the city income tax act on behalf of a city is entered into with any city; to provide an appropriation; to abolish the state board of tax administration; to prescribe penalties and provide remedies; and to declare the effect of this act,” by amending section 30 (MCL 205.30), as amended by 1993 PA 14.

Was read a second time, and the question being on the adoption of the proposed substitute (H-2) previously recommended by the Committee on Tax Policy,

A bill to amend 1951 PA 33, entitled “An act to provide police and fire protection for townships and for certain areas in townships, certain incorporated villages, and certain cities; to authorize contracting for fire and police protection; to authorize the purchase of fire and police equipment, and the maintenance and operation of the equipment; to provide for defraying the cost of the equipment; to authorize the creation of special assessment districts and the levying and collecting of special assessments; to authorize the issuance of special assessment bonds in anticipation of the collection of special assessments and the advancement of the amount necessary to pay such bonds, and to provide for reimbursement for such advances by reassessment if necessary; to authorize the collection of fees for certain emergency services in townships and other municipalities; to authorize the creation of administrative boards and to prescribe their powers and duties; to provide for the appointment of traffic officers and to prescribe their powers and duties; and to repeal acts and parts of acts,” by amending section 1 (MCL 41.801), as amended by 2002 PA 501.

The Clerk received the following dissent on House Bill No. 4139, from Rep. Irwin:

I continue to object to the use of procedural tricks to subvert the Constitutional rights of citizens to know accurately the actions of the House of Representatives. Once again, on HB 4139, immediate effect was ordered without a bona fide vote. Motions for immediate effect are routinely gaveled through without even a pretense of vote counting. This motion requires support from 2/3rds of the members and there is no genuine effort to ascertain the level of support for immediate effect. I object to this practice and I object to the erroneous assertions printed in the House Journal that suggest an authentic counting of votes occurred on the House floor.

The Clerk received the following dissent on Senate Bill No. 123, from Rep. Irwin:
