“In this season of thankfulness, Lord, we have much to be grateful for.

In our state we are surrounded by lakes and streams, forests and fields. Our cities and towns and homes are set in this landscape, and our seasons lived out in this beautiful environment, and we are thankful for the many ways it enriches our lives. Help us be good stewards of these gifts.

We have been blessed with family and friends, colleagues and supporters, and even strangers who have put their confidence in us. We are grateful for the privilege and responsibility of this leadership placed on our shoulders.

May we serve the people of Michigan well, with hearts and minds committed to doing what is good and just, not only for those we know and love, but for those with whom we find little in common as well.

I conclude with the words of Reverend Ted Loder:

Empower us

to be bold participants,

rather than timid saints in waiting,

in the difficult ordinariness of now;

to exercise the authority of honesty;

rather than to defer to power,

or deceive to get it;

to influence someone for justice,

rather than impress anyone for gain;

Motions and Resolutions

Reps. Darany, Barnett, Brown, Crawford, Denby, Driskell, Durhal, Geiss, Heise, Howrylak, Kelly, Lamonte, LaVoy, O’Brien, Roberts, Slavens and Stanley offered the following resolution:

House Resolution No. 270.

A resolution to commemorate the 150th anniversary of President Abraham Lincoln’s Gettysburg Address of November 19, 1863.

Whereas, It was one hundred and fifty years ago on the afternoon of November 19, 1863, that Abraham Lincoln, sixteenth President of these United States delivered what has been noted as one of the most eloquent speeches in the annals of American oratory. Lincoln’s Gettysburg Address was delivered at the dedication of the Soldiers National Cemetery, established in the aftermath of the bloody battle of Gettysburg, Pennsylvania July 1-3, 1863. Almost five thousand men from the Great Lakes State fought on that hallowed ground and over one thousand Michiganians became combat casualties in the horrific battle; and

Whereas, Thirteen regiments and units from Michigan participated in the great struggle on the charred battlefield of Gettysburg and the blood of Michigan men and boys helped to make that ground sacred. From the 16th Michigan Infantry’s defense of Little Round Top, where the regiment’s colors were shot from the staff and fell “enveloping the fallen with their silken folds like a funeral pall”, to Battery I of the First Michigan Light Artillery Regiment and the 7th Infantry’s defense against Pickett’s charge on Cemetery Ridge where their commander, Lieutenant Colonel Amos Steele of Mason, Michigan died, to the Michigan Cavalry Brigade’s heroic fight on the extreme right of the union line, where their commander Brigadier General George Armstrong Custer of Monroe, Michigan led his men into battle by extorting them to “Come on you wolverines”; and

Whereas, We also recognize and honor the 3rd Michigan Infantry’s defense of the Peach Orchard, the 5th Infantry’s stubborn defiance in the woods near the wheat field, the 4th Infantry’s tenacious hold of the wheat field, where their colonel, Harrison Jeffords of Dexter, Michigan died by bayonet while defending the colors of the regiment, at the loop between the wheat field and the Emmitsburg road the First Michigan fought with valor. We also remember the four companies of Michigan sharpshooters who fought and bravely died with Berdan’s U.S. sharpshooters at the wheat field and Little Round Top; and

Whereas, We must also pay tribute to the tremendous sacrifice paid by the Wayne county boys of the 24th Michigan of the famed Iron Brigade. Of the more than 400 union regiments engaged at Gettysburg, the 24th had the distinction of suffering among the highest casualties, by the end of the battle 80% of the regiment had been killed, wounded, or were listed as missing in action, including 9 men who died carrying the colors of the regiment; and

Whereas, These few, simple, and admittedly meager words shall not resurrect from the cold, shallow, hastily dug, graves of Pennsylvania, the flower of Michigan’s long ago martyred youth. However, by remembering these “honored dead” we can, in some small way, make their sacrifice worth the immeasurable price that was paid. Perhaps by paying homage to the words that President Abraham Lincoln said there we can honor “what they did there” and in the words of the great emancipator, remember those boys in blue, including those from the peninsular state, who “gave the last full measure of devotion”; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body commemorate the 150th anniversary of President Abraham Lincoln’s Gettysburg Address of November 19, 1863. We also honor the sacrifice made by the 90,000 Michigan soldiers and sailors who fought in the Civil War, and the 15,000 Michigan men who lost their lives, including those who were casualties on the battlefield of Gettysburg, Pennsylvania. We declare “that these dead shall not have died in vain—that this nation, under God, shall have a new birth of freedom—and that government of the people, by the people, for the people, shall not perish from the earth”.

House Resolution No. 271.

A resolution to declare November 2013 as Long-Term Care Awareness Month in the state of Michigan.

Whereas, The U.S. Census Bureau has projected that the population of Michigan residents age 65 and older will increase by nearly 70 percent to more than 2 million in 2030; and

Whereas, The U.S. Department of Health and Human Services has reported that 70 percent of people over the age of 65 will need long-term care services at some point, with more than 40 percent of this group requiring nursing home care and another 30 percent requiring in-home assistance; and

Whereas, In 2012, long-term care insurers paid $6.6 billion in claim payments to some 264,000 individuals and by 2032 insurers are expected to pay $34 billion-a-year in benefits which is a 415 percent increase; and

Whereas, The average cost for a semi-private room in a nursing facility costs is nearly $75,000 a year and costs associated with long-term care needs are expected to continue to increase; and

Whereas, The U.S. Department of Health and Human Services has reported less than 33 percent of adults over the age of 50 have begun saving for their long-term care needs; and

Whereas, Michigan citizens should recognize this critical situation and with the assistance and cooperation of state and federal government and businesses of all sizes, begin to take the appropriate steps to ensure that individuals and their families’ long-term care needs can be met; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare November 2013 as Long‑Term Care Awareness Month in the state of Michigan.

Rep. Barnett offered the following resolution:

House Resolution No. 272.

A resolution to declare October 31, 2013, to November 28, 2013, as Pumpkin and Pumpkin Spice Season in the state of Michigan.

Whereas, Pumpkins retain historical significance as they were frequently utilized among Native Americans and colonists prior to Michigan attaining statehood in 1837 whether the pumpkin was utilized as a water vessel or bowl, in cooking pumpkin pie, among other applications; and

Whereas, Pumpkins today are recognized for being low in calories, fat, sodium, and are exceptional sources of Vitamin A, Vitamin B, potassium, iron, and protein; and

Whereas, The Michigan Vegetable Council concluded that the growth and cultivation of pumpkins generated approximately $16.8 million from 98.6 million pounds of pumpkins alone, helping our local and state economies thrive; and

Whereas, The Michigan Department of Agriculture and Rural Development recognizes Michigan as one of the leading states in the United States in the production of pumpkins as an agricultural commodity; and

Whereas, Pumpkin spice is a seasoning which typically includes a mixture of cinnamon, nutmeg, ginger, and cloves that provides a vibrant taste and seasonal theme; and

Whereas, The pumpkin spice seasoning has retained contemporary cultural significance as numerous businesses in Michigan have utilized it in a variety of food products and cosmetics among other applications; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare October 31, 2013, to November 28, 2013, as Pumpkin and Pumpkin Spice Season in the state of Michigan. We promote state enthusiasm among our residents as we celebrate the popularity of pumpkins and the pumpkin spice seasoning. We encourage Michigan residents and businesses from every community throughout our great state to acknowledge and support the spirit of pumpkins and the pumpkin spice seasoning throughout the fall season.

A bill to amend 1933 (Ex Sess) PA 18, entitled “An act to authorize any city, village, township, or county to purchase, acquire, construct, maintain, operate, improve, extend, and repair housing facilities; to eliminate housing conditions which are detrimental to the public peace, health, safety, morals, or welfare; and for any such purposes to authorize any such city, village, township, or county to create a commission with power to effectuate said purposes, and to prescribe the powers and duties of such commission and of such city, village, township, or county; and for any such purposes to authorize any such commission, city, village, township, or county to issue notes and revenue bonds; to regulate the issuance, sale, retirement, and refunding of such notes and bonds; to regulate the rentals of such projects and the use of the revenues of the projects; to prescribe the manner of selecting tenants for such projects; to provide for condemnation of private property for such projects; to confer certain powers upon such commissions, cities, villages, townships, and counties in relation to such projects, including the power to receive aid and cooperation of the federal government; to provide for a referendum thereon; to provide for cooperative financing by 2 or more commissions, cities, villages, townships, or counties or any combination thereof; to provide for the issuance, sale, and retirement of revenue bonds and special obligation notes for such purposes; to provide for financing agreements between cooperating borrowers; to provide for other matters relative to the bonds and notes and methods of cooperative financing; for other purposes; and to prescribe penalties and provide remedies,” by amending section 44 (MCL 125.694).

1. Amend page 20, following line 20, by inserting:

“Sec. 11525a. (1) The owner or operator of a landfill shall pay a surcharge as follows:

(a) Except as provided in subdivision (b), 12 50 cents for each cubic yard or portion of a cubic yard of solid waste or municipal solid waste incinerator ash that is disposed of in the landfill before October 1, 2015.2016.

(b) For type III landfills that are captive facilities, the following annual amounts:

(i) For a captive facility that receives 100,000 or more cubic yards of waste, $3,000.00.

(ii) For a captive facility that receives 75,000 or more but less than 100,000 cubic yards of waste, $2,500.00.

(iii) For a captive facility that receives 50,000 or more but less than 75,000 cubic yards of waste, $2,000.00.

(iv) For a captive facility that receives 25,000 or more but less than 50,000 cubic yards of waste, $1,000.00.

(v) For a captive facility that receives less than 25,000 cubic yards of waste, $500.00.

(2) The owner or operator of a landfill shall pay the surcharge under subsection (1)(a) within 30 days after the end of each quarter of the state fiscal year. The owner or operator of a type III landfill that is a captive facility shall pay the surcharge under subsection (1)(b) by January 31 of each year.

(3) The owner or operator of a landfill who is required to pay the surcharge under subsection (1) shall pass through and collect the surcharge from any person who generated the solid waste or who arranged for its delivery to the solid waste hauler or transfer facility notwithstanding the provisions of any contract or agreement to the contrary or the absence of any contract or agreement.

(4) Surcharges collected under this section shall be forwarded to the state treasurer. for deposit THE STATE TREASURER SHALL DEPOSIT 24% OF THE SURCHARGE REVENUE COLLECTED UNDER SUBSECTION (1)(A) AND ALL THE SURCHARGE REVENUE COLLECTED UNDER SUBSECTION (1)(B) in the solid waste staff account of the solid waste management fund established in section 11550. THE STATE TREASURER SHALL DEPOSIT 76% OF THE SURCHARGE REVENUE COLLECTED UNDER SUBSECTION (1)(A) IN THE RECYCLING FUND CREATED IN SUBSECTION (5).

(5) THE RECYCLING FUND IS CREATED WITHIN THE STATE TREASURY. THE STATE TREASURER MAY RECEIVE MONEY OR OTHER ASSETS FROM ANY SOURCE FOR DEPOSIT INTO THE RECYCLING FUND. THE STATE TREASURER SHALL DIRECT THE INVESTMENT OF THE FUND. THE STATE TREASURER SHALL CREDIT TO THE FUND INTEREST AND EARNINGS FROM FUND INVESTMENTS. MONEY IN THE RECYCLING FUND AT THE CLOSE OF THE FISCAL YEAR SHALL REMAIN IN THE RECYCLING FUND AND SHALL NOT LAPSE TO THE GENERAL FUND. THE DEPARTMENT SHALL BE THE ADMINISTRATOR OF THE RECYCLING FUND FOR AUDITING PURPOSES.

(6) THE DEPARTMENT SHALL EXPEND MONEY FROM THE RECYCLING FUND, UPON APPROPRIATION, ONLY TO SUPPORT STATE AND LOCAL PROGRAMS TO INCREASE RECYCLING.

(7) (5) As used in this section, “captive facility” means a landfill that accepts for disposal only nonhazardous industrial waste generated only by the owner of the landfill or a nonhazardous industrial waste landfill that is specified in section 11525(3).”.
