A bill to amend 1899 PA 44, entitled
"An act to provide for the publication and distribution of
publications, laws, and documents, reports of the several officers,
boards of officers and public institutions of this state now or
hereafter to be published; to provide for the replacing of
publications lost by fire or otherwise; to provide for the
publication and distribution of the Michigan manual; to provide for
duties of certain state and local government departments and
agencies; to establish certain funds; and to provide for certain
penalties and remedies,"
by amending section 34 (MCL 24.34).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec.
34. Every A person or officer who shall receive receives
any
of the books distributed by the secretary of state ,
which are
required
by that this act to be placed in his library, requires the
person to retain, and each city, village, township, and county
officer,
shall , when he ceases to hold such office, deliver over
to
his or her successor in office all such of those books. received
by
him; and any person who shall neglect or refuse to deliver over
to
his successor in office all such books, received by him as
aforesaid,
shall be A person who does
not do so is liable to such
his
or her successor in an action for
money had and received to the
full
amount it shall cost him to furnish himself with such for the
cost
of replacing those books , and costs of suit. ; which An
action shall, on request, be brought and prosecuted by the
prosecuting
attorney of for the county.
; and any A person
who
shall
knowingly and wilfully retain
any such willfully retains
those
books in his possession, or refuse or refuses to pass deliver
them
over to his the successor
, shall also be subject to a penalty
in
a sum not exceeding 50 dollars, or be imprisoned in the county
jail
not exceeding 3 months, or both, in the discretion of the
court:
Provided, however, That township and county officers
receiving
the abstract of reports of county superintendents of the
poor,
of sheriffs, or of the insane, deaf, dumb and blind, shall
not
be required to pass them over to their successors.officer is
guilty of a misdemeanor punishable by imprisonment for not more
than 90 days or a fine of not more than $50.00, or both.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
