HOUSE BILL No. 5344

     A bill to amend 1897 PA 205, entitled

 

"An act to prefer honorably discharged members of the armed forces

of the United States for public employments,"

 

by amending section 1 (MCL 35.401), as amended by 2008 PA 28.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. (1) In every public department and upon the public

 

works of the state and of every county and municipal corporation of

 

this state, an honorably discharged veteran, as defined by 1965 PA

 

190, MCL 35.61 to 35.62, a veteran shall be preferred for

 

appointment and employment. Age, loss of limb, or other physical

 

impairment that does not, in fact, incapacitate, does not

 

disqualify them. If it is necessary to fill by appointment a

 

vacancy occurring in an elective office, the appointment is within

 

subject to this act. The applicant shall be of good moral character

 

and shall have been a resident of the state for at least 2 years

 


and possess other requisite qualifications, after credit allowed by

 

the provisions of any civil service laws. If there is a conflict

 

between the provisions of this act and 1941 PA 370, MCL 38.401 to

 

38.428, the provisions of 1941 PA 370, MCL 38.401 to 38.428, shall

 

prevail.

 

     (2) As used in this section, "veteran" means an individual who

 

meets both of the following:

 

     (a) Is a veteran as defined in section 1 of 1965 PA 190, MCL

 

35.61.

 

     (b) Was honorably discharged.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No. ____ or House Bill No. 5332 (request no.

 

02698'15 *) of the 98th Legislature is enacted into law.
