SUMMARY:

House Bill 4919 would amend the Michigan Vehicle Code to give a motorcycle that is part of a motorcycle procession the right of way over all other nonemergency vehicles at a street or highway intersection if the motorcycle is displaying a fluorescent orange flag.

The lead motorcycle and the last motorcycle in the motorcycle procession could carry an additional flag. The orange flags, and any additional flag, could not be embossed or printed with a name.

A person passing through a motorcycle procession with any kind of vehicle would be responsible for a civil infraction.

The bill would take effect 90 days after being enacted into law.

BACKGROUND:

The language of the proposed Section 654a replicates that of Section 654, which extends the traffic right of way to a funeral procession going to a place of burial.

FISCAL IMPACT:

The bill would result in a minimal increase in revenues to the state. A violation of the bill would be a civil infraction. Revenue collected from payment of civil infraction penalties is deposited into the state Justice System Fund, which supports various justice-related endeavors in the judicial branch and the Departments of State Police, Corrections, and Health and Human Services.
