MIOSHA: ALLOW EMPLOYER-DESIGNATED CONTACT

SUMMARY:

House Bill 5088 would allow an employer to designate an individual as a contact person to receive any notice required to be given by the Department of Licensing and Regulatory Affairs (LARA) under the Michigan Occupational Safety and Health Act (MIOSHA).

Specifically, the bill would add a new section to MIOSHA to allow an employer to designate an individual to receive any notice required to be given by LARA under the act. The designation must be in writing and would have to include the designated individual’s name, mailing address, telephone number, and email address. Further, LARA would be required to maintain a registry of the information provided by employers regarding the designated individuals on its website. The registry would have to be available to the public at no cost.

The bill would take effect 90 days after being enacted.

FISCAL IMPACT:

House Bill 5088 would cause a significant increase in costs for the Department of Licensing and Regulatory Affairs. LARA has indicated that the Department of Technology, Management, and Budget estimates that the creation of the registry required by the bill would cost the department $624,000. LARA estimates that an additional .5 FTE and $74,400 would be required to maintain the registry on an ongoing basis. It is not altogether clear how these costs would be supported.
