AGRICULTURE EQUIPMENT EXEMPTION

SUMMARY:
Currently under Section 726 of the Michigan Vehicle Code, local authorities and county road commissions may, by ordinance or resolution, do the following with respect to highways under their jurisdiction, except for state trunk line highways:
· Prohibit the operation of trucks or other commercial on designated highways or streets.
· Impose limitations on the weight of trucks or other commercial vehicles on designated highways or streets.
· Provide that only certain highways or streets may be used by trucks or other commercial vehicles (i.e., “truck routes”).
House Bill 5945 would amend Section 726 to specify that such an ordinance or resolution does not apply to a vehicle that is used to transport agricultural products, farm machinery, farm supplies, or a combination of these items, to or from a farm or as necessary for agricultural production.
The bill would take effect 90 days after enactment.

FISCAL IMPACT:
The bill would have no direct fiscal impact on the state or on local units of government.
Under current law, a person who violates a prohibition, limitation, or truck route designation established under the section is responsible for a civil infraction. The bill would not change these civil infraction provisions. However, the bill could have a marginal impact on the number of civil infraction citations issued and related civil fine revenue by reducing the number of persons subject to civil infraction fines.
