CONTENT

 

The bill would amend the Revised School Code to require a school district or public school academy to consult with the local law enforcement agency before commencing construction or major renovation of a school building.

 

Specifically, the bill would prohibit a school district, intermediate school district (ISD), or public school academy (PSA) from the commencing the construction of a new school building or the major renovation of an existing school building unless both of the following were met:

 

 --    The school district, ISD, or PSA consulted on the plans for the construction or the major renovation with the local law enforcement agency that had jurisdiction over the municipality in which the greatest number of pupils enrolled in the school district, ISD, or PSA resided.

 --    After consulting with a local law enforcement agency, the board of the school district or ISD or the board of directors of the PSA adopted plans for the construction or renovation by a majority vote of the members serving on the board or board of directors held at a public meeting in compliance with the Open Meetings Act.

 

Under the bill, "school building" would mean either of the following:

 

 --    A building intended to be used to provide instruction for pupils.

 --    A recreational or athletic structure or field intended to be used by pupils.

 

The bill would take effect 90 days after it was enacted.

FISCAL IMPACT

 

The bill would have no fiscal impact on the Department of Education and would add marginal costs to intermediate school districts, school districts, and public school academies that construct or renovate school buildings, as well as local l law enforcement agencies. The costs would apply only to those districts and academies that construct and renovate school buildings, and the law enforcement agencies with jurisdiction over the municipalities where those schools are located. The marginal costs added to the construction or renovation planning process are indeterminate, because of the differences between local units.
