      A bill to amend 2016 PA 407, entitled

 

"Skilled trades regulation act,"

 

by amending sections 707 and 715 (MCL 339.5707 and 339.5715).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

 1        Sec. 707. (1) The Subject to subsection (9), the examination

 

 2  fee for licensure of any of the following is $100.00:

 

 3        (a) Master electrician.

 

 4        (b) Electrical contractor.

 

 5        (c) Electrical journeyman.

 

 6        (d) Fire alarm contractor.

 

 7        (e) Fire alarm specialty technician.

 

 8        (f) Sign specialty contractor.

 


 1        (g) Sign specialist.

 

 2        (2) The fee for an initial license, an apprentice electrician

 

 3  registration, or renewal of a license relating to electricians is

 

 4  as follows:

 

 

 5

       (a) Master electrician.........................  $ 50.00.

 6

       (b) Electrical journeyman......................  $ 40.00.

 7

       (c) Apprentice electrician.....................  $ 15.00.

 

 

 8        (3) The fee for an initial fire alarm specialty technician

 

 9  license, a fire alarm specialty apprentice technician registration,

 

10  or renewal of that license or registration is as follows:

 

 

11

       (a) Fire alarm specialty technician............  $ 50.00.

12

       (b) Fire alarm specialty apprentice technician.  $ 15.00.

 

 

13        (4) The fee for an initial sign specialist license or renewal

 

14  of a sign specialist license is $40.00.

 

15        (5) An apprentice electrician or specialty apprentice

 

16  technician registration expires on August 31 of each year and is

 

17  renewable within 30 days after that date if a renewal fee is paid.

 

18  The amount of the fee is $15.00. An applicant for registration

 

19  under this subsection must submit proof of a sponsoring employer

 

20  for initial or renewal registration.

 

21        (6) Except as otherwise provided in subsection (5) or (7), a

 

22  license expires on December 31 of each year and is renewable not

 

23  more than 60 days after that date if an application is submitted

 

24  and the appropriate fee is paid. After March 1 of each year or

 

25  after March 1 of the renewal year in the case of electrical

 


 1  contractors, fire alarm contractors, or sign specialty contractors,

 

 2  a license that is not renewed is void and the contractor may only

 

 3  be relicensed if an application for relicensure is submitted and

 

 4  the appropriate license fee for the appropriate class is paid.

 

 5        (7) A license for an electrical contractor, fire alarm

 

 6  contractor, or sign specialty contractor expires December 31 of

 

 7  every third year. A license for an electrical contractor, fire

 

 8  alarm contractor, or sign specialty contractor is renewable not

 

 9  later than on March 1 every third year by submitting an application

 

10  and paying 1 of the following amounts:

 

11        (a) A fee of $300.00 by electrical contractors and fire alarm

 

12  contractors.

 

13        (b) A fee of $200.00 by sign specialty contractors.

 

14        (8) If a person that is applying for an initial contractor's

 

15  license or for relicensure at a time other than between December 31

 

16  and March 1 of the year in which the department issues renewal

 

17  licenses, the department shall compute and charge the 3-year

 

18  license fee described in subsection (7) on a yearly pro rata basis

 

19  beginning in the year of the application until the last year of the

 

20  3-year license cycle.

 

21        (9) The department shall waive any examination fee otherwise

 

22  required under subsection (1) if the license applicant is an

 

23  individual who served in the armed forces and he or she provides to

 

24  the department a form DD214 or form DD215, or any other form that

 

25  is satisfactory to the department, that demonstrates that he or she

 

26  was separated from that service with an honorable character of

 

27  service or under honorable conditions (general) character of


 1  service.

 

 2        Sec. 715. (1) The department shall issue an electrical

 

 3  journeyman's license to any individual who is at least 20 years

 

 4  old, meets the requirements described in article 2, and meets

 

 5  either of the following:

 

 6        (a) Has at least 8,000 hours of experience obtained over a

 

 7  period of at least 4 years related to electrical construction or

 

 8  maintenance of buildings or electrical wiring or equipment under

 

 9  the direct supervision of an individual who is licensed under this

 

10  article.

 

11        (b) While on active duty in the armed forces, served as an

 

12  interior electrician or in an equivalent job classification; was

 

13  honorably discharged from that military service in the 1-year

 

14  period preceding the date the license application is filed;

 

15  provides to the department a form DD214 or form DD215, or any other

 

16  form that is satisfactory to the department, that demonstrates that

 

17  he or she was separated from military service with an honorable

 

18  character of service or under honorable conditions (general)

 

19  character of service; and has, and provides with his or her

 

20  application, an affidavit signed by a commanding officer,

 

21  supervisor, or military superior with direct knowledge of the

 

22  applicant's service that states that he or she has, at least 8,000

 

23  hours of entry-level experience in and basic knowledge of each of

 

24  the following:

 

25        (i) General knowledge of the electrical trade, including

 

26  terminology and the ability to make practical calculations.

 

27        (ii) The determination of system and circuit grounding and


 1  design and use requirements for grounding, including choosing

 

 2  proper size grounding conductors.

 

 3        (iii) Knowledge of circuit classifications and ratings and

 

 4  design and use requirements for circuits, including branch circuit

 

 5  loads.

 

 6        (iv) The determination of ampacity, type of insulation, usage

 

 7  requirements, methods of installation, protection, support, and

 

 8  termination.

 

 9        (v) Knowledge regarding the installation of motors and control

 

10  circuits.

 

11        (vi) The calculation of electrical loads and determination of

 

12  proper size, rating, and type of service and feeder conductors.

 

13        (vii) Knowledge regarding fuses, circuit breakers, and all

 

14  types of protective devices for conductors and equipment.

 

15        (viii) Knowledge of all types of raceways and their uses,

 

16  including determining proper size, conductor fill, support, and

 

17  methods of installation.

 

18        (ix) Knowledge of circuits and equipment characterized by

 

19  usage and electrical power limitations, including differentiating

 

20  them from electric light and power circuits.

 

21        (x) Knowledge of all types and applications of lighting

 

22  fixtures, ratings, requirements for occupancies, special

 

23  provisions, and clearances.

 

24        (2) If an applicant who otherwise meets the requirements of

 

25  subsection (1)(b) has not attained 8,000 hours of entry-level

 

26  experience or does not have basic knowledge in each of the areas

 

27  described in subsection (1)(b)(i) to (x), he or she may provide


 1  with his or her application an affidavit signed by a commanding

 

 2  officer, supervisor, or military superior with direct knowledge of

 

 3  the applicant's service that states the amount of experience the

 

 4  applicant has attained and of which of the areas described in

 

 5  subsection (1)(b)(i) to (x) the applicant has basic knowledge, and

 

 6  the department may in its discretion grant the applicant credit

 

 7  toward the 8,000-hour experience requirement of subsection (1)(a)

 

 8  based on the applicant's experience.

 

 9        (3) If an applicant fails to pass the electrical journeyman

 

10  examination 2 times within a period of 2 years, the applicant is

 

11  ineligible to sit for another examination until a period of at

 

12  least 1 year after the date of failure of the second examination.

 

13  After that 1-year period, he or she is again eligible to sit for an

 

14  electrical journeyman's license if he or she presents to the board

 

15  proof of the successful completion of a course on Michigan

 

16  electrical code, electrical fundamentals, or electrical theory

 

17  approved by the board.

 

18        (4) As a condition of renewal of an electrical journeyman's

 

19  license, the electrical journeyman must demonstrate the successful

 

20  completion of a course, approved by the board, concerning any

 

21  update or change in the state construction code within 12 months

 

22  after the update or change in that code. This requirement applies

 

23  only during or after those years that the state construction code

 

24  is updated or changed.

 

25        Enacting section 1. This amendatory act takes effect 90 days

 

26  after the date it is enacted into law.
