A bill to require the submitting of certain reports by certain
law enforcement agencies to the Michigan commission on law
enforcement standards; and to prescribe certain duties of law
enforcement agencies.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. This act shall be known and may be cited as the "use
of force by law enforcement reporting act".
Sec. 2. As used in this act:
(a) "Commission" means the Michigan commission on law
enforcement standards created in section 3 of the Michigan
commission on law enforcement standards act, 1965 PA 203, MCL
28.603.
(b) "Law enforcement agency" means that term as defined in
section 2 of the Michigan commission on law enforcement standards
act, 1965 PA 203, MCL 28.602.
(c) "Use of force report" or "report" means the report
required under section 3.
Sec. 3. (1) Each law enforcement agency in this state, once
each year on a date and in a form prescribed by the commission,
shall forward to the commission a use of force report. The report
must not contain the name of any individual.
(2) The report must include all of the following information
involving the use of physical controls, intermediate controls, or
deadly force response, or each of the equivalent use of force
categories if the commission updates the subject control continuum,
by a law enforcement officer as described in the commission subject
control continuum for the year preceding the year of the report:
(a) The number and type of use of force complaints made
against officers of the agency submitting the report.
(b) The number of shooting incidents involving officers of the
agency submitting the report.
(c) The disposition of all investigations into use of force
complaints against, and shooting incidents involving, officers of
the agency submitting the report.
(d) The racial, ethnic, and gender demographic data of
individuals who made use of force complaints against officers of
the agency submitting the report.
(e) The racial, ethnic, and gender demographic data of
individuals who were involved in shooting incidents involving
officers of the agency submitting the report.
(3) If a law enforcement agency maintains a public website,
the agency shall publish the report required under this section on
its website.
Enacting section 1. This act takes effect 90 days after the
date it is enacted into law.
