     A bill to amend 1968 PA 2, entitled

 

"Uniform budgeting and accounting act,"

 

(MCL 141.421 to 141.440a) by adding section 3a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 3a. (1) Beginning October 1, 2017, if the lowest

 

responsive and responsible bidder on a contract for goods or

 

services with a local unit is not a Michigan business, then all

 

bidders on that contract that are Michigan businesses have 30 days

 

to resubmit their bids to match or beat the bid from the bidder

 

that is not a Michigan business. If only 1 Michigan business that

 

bid on the contract resubmits a bid under this subsection that

 

matches or beats the successful bid from the bidder that is not a

 

Michigan business, the local unit shall enter into the contract

 


with that Michigan business. If 2 or more Michigan businesses that

 

bid on the contract resubmit a bid under this subsection that

 

matches or beats the successful bid from the bidder that is not a

 

Michigan business, the local unit shall enter into the contract

 

with the Michigan business that submitted the lowest responsive and

 

responsible bid as determined by the local unit. The local unit

 

shall make all discretionary determinations to implement this

 

subsection. The local unit shall issue directives to all

 

departments in the local unit to implement this subsection.

 

     (2) As used in this section, "Michigan business" means that

 

term as described in section 268 of the management and budget act,

 

1984 PA 431, MCL 18.1268.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
