A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 43540f.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 43540f. (1) Beginning June 1, 2018, when an individual
applies for a license under this part, the department or the
department's agent shall ask whether the individual would like to
donate $1.00, $5.00, or $10.00 to the chronic wasting disease fund
created under this section and, if so, shall collect the donation
with the license fee. A person designated by the department to
issue licenses shall not receive a commission under section 43541
for the donation.
(2) A donation under subsection (1) is in addition to the
license fee.
(3) The department shall transfer donations under subsection
(1) to the state treasurer for deposit in the fund.
(4) The chronic wasting disease fund is created within the
state treasury.
(5) The state treasurer may receive money or other assets from
any source for deposit into the fund. The state treasurer shall
direct the investment of the fund. The state treasurer shall credit
to the fund interest and earnings from fund investments. The
department shall be the administrator of the fund for auditing
purposes.
(6) Money in the fund at the close of the fiscal year remains
in the fund and does not lapse to the general fund.
(7) Money from the fund must be expended, upon appropriation,
only by the department for 1 or more of the following purposes:
(a) To administer the fund, including the costs of collecting
donations to the fund.
(b) To conduct research on chronic wasting disease in free-
ranging deer or elk in this state.
(c) To conduct research for elimination of the prion.
(d) To provide for surveillance of chronic wasting disease,
including the collection of hunter harvested submissions and
testing of free-ranging deer.
(e) To provide for educational materials and outreach about
chronic wasting disease to affected stakeholders and the public.
(f) To enforce orders under section 40118(17) regarding
importation of cervid carcasses.
(8) The department shall not incur costs described in
subsection (7) that exceed the amount of revenue in the fund
available to cover those costs.
(9) As used in this section, "fund" means the chronic wasting
disease fund created in subsection (4).
Enacting section 1. This amendatory act does not take effect
unless all of the following bills of the 99th Legislature are
enacted into law:
(a) Senate Bill No.____ or House Bill No. 5770 (request no.

(b) Senate Bill No.____ or House Bill No. 5771 (request no.
05140'17).
