     A bill to amend 1980 PA 299, entitled

 

"Occupational code,"

 

(MCL 339.101 to 339.2677) by adding section 1486 to article 14B.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1486. (1) The operator of any adult entertainment

 

business shall ensure that all of the following are met:

 

     (a) All doors to public areas of the premises are unlocked.

 

     (b) All rooms and other areas of the premises are readily

 

accessible at all times for inspection by any peace officer, the

 

director, or any employee of the department.

 

     (c) If the adult entertainment business provides live

 

entertainment, private locker room facilities that include a

 

shower, a sink, and toilet facilities are provided to the

 

entertainers.

 


     (d) Admission is restricted to individuals who are 18 years of

 

age or older.

 

     (2) A licensee that operates an adult arcade shall ensure that

 

all of the following are met:

 

     (a) The interior of the show premises are arranged in such a

 

manner as to ensure that patrons are fully visible from the waist

 

down, and all individuals who are viewing panorama pictures are

 

visible from the common areas of premises of the adult arcade.

 

     (b) Not more than 1 patron at a time is present in a booth,

 

cubicle, room, or stall in which adult entertainment is provided.

 

     (3) A licensee that operates an exotic dance studio that has a

 

VIP room shall ensure that the VIP room is not fully enclosed; that

 

at least 1 wall of the VIP room provides an open view into the VIP

 

room from areas of the studio that are open to the public; and that

 

the open view into the VIP room is not obstructed. As used in this

 

subsection, "VIP room" means a room or area to which access is

 

restricted to patrons who have requested private dances.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No.____ or House Bill No. 5972 (request no.

 

04795'17) of the 99th Legislature is enacted into law.
