A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1290.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1290. (1) Not later than July 1, 2020, the department and
the department of health and human services shall develop or adopt,
and shall make available to schools, at least 1 baseline concussion
test that tests at least all of the following:
(a) Reaction time.
(b) Memory capacity.
(c) Speed of mental processing.
(d) Executive functioning.
(2) Beginning in the 2020-2021 school year, and at least
annually in each subsequent school year, a public or nonpublic
school operating an interscholastic athletics program may conduct
and offer to pupils a baseline concussion test developed or adopted
under this section.
(3) A public or nonpublic school that conducts and offers the
baseline concussion test developed or adopted under this section
shall encourage all pupils participating in an interscholastic
athletics program to take the baseline concussion test at least
biennially.
(4) As used in this section:
(a) "Baseline concussion test" means a test of an individual's
brain functions that are commonly affected by a concussion and for
the presence of concussion symptoms.
(b) "Concussion" means that term as defined in section 9155 of
the public health code, 1978 PA 368, MCL 333.9155.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
