SENATE BILL No. 355

     A bill to prohibit municipalities from lowering or raising age

 

requirements provided for in state law; to prescribe the powers and

 

duties of certain local officers and officials; and to provide that

 

certain local ordinances or resolutions are void and unenforceable.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. This act shall be known and may be cited as the "local

 

government age preemption act".

 

     Sec. 3. As used in this act:

 

     (a) "Governing body" means the body in which the legislative

 

powers of a municipality are vested.

 

     (b) "Municipality" means a county, city, village, or township.

 

     Sec. 5. Beginning on the effective date of this act, the

 

governing body of a municipality shall not adopt or enforce an

 

ordinance or resolution that lowers or raises an age requirement

 


provided for in state law.

 

     Sec. 7. Any provision in an ordinance or resolution adopted by

 

the governing body of a municipality on or after the effective date

 

of this act that lowers or raises an age requirement provided for

 

in state law is void and unenforceable.

 

     Enacting section 1. This act takes effect 90 days after the

 

date it is enacted into law.
