PROHIBIT RULES TO BAN VAPOR DEVICES

SUMMARY:

House Bill 5019 would amend the Public Health Code to prohibit the Department of Health and Human Services (DHHS) from promulgating or enforcing any rule, including an emergency rule, that bans the sale, manufacture, or use of a vapor product (such as a vape pen or cartridge), including a flavored vapor product.

Vapor product would mean that term as defined in the Youth Tobacco Act[1] if the vapor cartridge or other container of nicotine or other substance contained                    20 milliliters or less of nicotine or another substance.

Flavored vaping product would mean a vaping product that imparts a taste or aroma before or during its use, except for the taste or aroma of a tobacco product.

FISCAL IMPACT:

House Bill 5019 has no fiscal implications for state or local government.
