CONTENT

 

The bill would amend the Small Wireless Communications Facilities Deployment Act to define "county road commission" and to include the term within the definition of "authority".

 

Generally, the Act prohibits an authority from prohibiting, regulating, or charging for the collocation of small cell wireless facilities and prescribes the process for an authority to follow when reviewing a wireless provider's application for certain collocations. The Act defines "authority", unless context implies otherwise, as the State or a county, township, city, village, district, or subdivision thereof if authorized by law to make legislative, quasi-judicial, or administrative decisions concerning an application under the Act. The bill would include a county road commission in the definition.

FISCAL IMPACT

 

The bill would not have a significant fiscal impact on State or local government. By adding county road commissions to the definition of "authority" under the Act, the bill would clarify the entities under its jurisdiction, and the regulation of the right-of-way.
