A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
by amending section 552a (MCL 750.552a).
the people of the state of michigan enact:
Sec. 552a. (1) Any A person who shall dump, deposit dumps, deposits, or place places any filth, garbage or refuse that is in the amount of less than 5 cubic yards on the grounds or premises of another person, without the specific permission of the owner thereof, shall be of the grounds or premises, is guilty of a misdemeanor punishable by imprisonment for not more than 90 days or a fine of not more than $500.00, or both.
(2) A person who dumps, deposits, or places any garbage or refuse that is in the amount of 5 cubic yards or more on the grounds or premises of another person, without the specific permission of the owner of the grounds or premises, is guilty of a misdemeanor punishable by imprisonment for not more than 1 year or a fine of not more than $2,500.00, or both.
(3) A person who commits a second or subsequent violation of subsection (2) is guilty of a felony punishable by imprisonment for not more than 5 years or a fine of not more than $7,500.00, or both.
Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.
